154 Honrble the Lord proprietary &c and also against the form of the act of assembly in that Case made and provided L Gale P Som prop.r Test Ann Hayman, Bridgett Colligon, Susannah Floyd, Sidney Brown, Eliz.a Brown, W.m Wye Sen.r Wm Wye Junr On the back side of the foregoeing bill of Indictment it was endorsed Billa Vera Edward Rownd foreman Afterwards the twenty first day of march One thousand Seven Hundred and thirty One before his Lordships Justices of Somerset ^County^ Court then held at dividing Creek then held for the County aforesaid Cometh the aforesaid John Horsey and being by the Sher of the County aforesaid Led to the barr is thereupon Instantly asked how he would acquitt himselfe of the felony above upon him Imposed says that ^of the felony afd^ he is not Guilty thereof and of good and Evill putts himselfe upon the Country and the aforesaid Levin Gale Esq.r who for his said Lordship in that part followeth likewise &c Whereupon Command was ^Given^ to the Sher of the County aforesaid that Immediately he Cause to Come before the aforesaid Justices ^here^ twelve &c by whom &c who neither &c to Recognizance &c and upon this the Jurors of that Same Jury being by the Sher Impannelled who being Called Came to witt Parker Selby, John Purnall Jun.r Peter Fraser, Joshua Sturges John Brittingham Robert Mitchell, John Webb, Richard Knight, Isaac Atkinson Angello Atkinson, Thomas Collings, John Dennis Sen.r who to Say the truth in the premisses being duely Elected tryed and Sworn upon their Oath do say that the aforesaid John Horsey is not Guilty of the felony in the Indictment aforesaid above upon him Imposed in manner and form as by the Same Indictment against him is Supposed whereupon all and Singular the premisses by the Court here being seen and fully understood It is Considered that the aforesaid John Horsey Goe thereof without day &c and that the afd Sheetts of and pillow cases of Cotten and Linnen be restored to the party prosecuted and furthere It is ordered that the aforesaid John Horsey Give Security for the payment of the Severall Officers their fees due by Occasion of the premisses afd thereupon a Certain Willm Horsey present here in Court undertakes for the Said John Horsey for to pay the Severall Officers their fees due as aforesaid &c Ann Hayman, Bridgett Colligon Susannah Floyde Sidney Brown, Eliz.a Brown and William Wye Sen.r all Severally appeared to their Recognizance for to Give evidence on behalfe of his Lordships and were all severally discharged &c
the said William Horsey is Committed into the Custody of the Sher of Somerset County thereto Remaine &c the Said Sher to witt Joshua Caldwell Gent present here in Court took Charge of the Said William Horsey accordingly &c
