      of Christopher Dashiell
 Somerset ss  Walter Jacobs late of Somerset County Carpenter and Elizabeth
his wife admrx of the Goods and Chattells of Christopher Dashiell Late of
Somerset County dec.d al.s dict Christopher Dashiell of Somerset County in
the province of Maryland dec.d were Sumoned to answer unto Betty Gale of
                            a plea that they Render unto her ninteen pounds ten Shillings and ten pence Currant
money of Maryland which from her they unjustly detaine &.c

                      And whereupon the Same Betty by Levin Gale her attorney says that whereas the aforesaid
Christopher in his life to wit the               day of            Ann.o Dom One thousand Seven hundred
and                  at Somerset County within the Jurisdiction of this Court by his Certain Writing Obligatory
Granted himselfe to be held unto the Same Betty in the aforesaid ninteen pounds ten Shillings and
ten pence Currant money of Maryland to be paid unto the Same Betty when thereof he Should be required
Nevertheless the afd Christopher in his life and the afd Eliz.a after the death of the Same Christopher
whilst she was Sole also the afd Walter and Eliz.a after the Espousalls between them Celebrated altho'
often required the afd Ninteen pounds ten Shillings and ten pence to the Same Betty as Yett hath not
rendered but the Same to her to render hath denied and the aforesaid Walter and Eliz.a the same to the
Said Betty as Yett denyeth and unjustly detaineth whereupon she Saith that she is worse and hath
damage to the value of thirty pounds Like money and thereupon she brings suite &.c and offers
herein Court the writing obligatory afd which the debt afd doth testifie &.c

    And the aforesaid Walter Jacobs and Elizabeth his wife by George Dashiell their attorney Come and
defend the force and Injury when &.c and prayed leave thereof to Imparle here untill the next Court
and ^they^ had it and the Same day is Given to the afd Betty here also &.c

    Att which said next Court to witt the Seventeenth day of august One thousand Seven hundred &
thirty One Came againe as well the afd Betty as the afd Walter and Eliz.a his wife by their attorneys
aforesaid and whereupon the Same Walter and Eliz.a prayed further Leave thereof to Imparle
here untill the next Court and they had it & the Same day is Given to the afd Betty here also &.c

    Att which said next Court to witt the sixteenth day of November one thousand seven hundred and
thirty one Came againe the afd Betty Gale by her attorney afd and the afd Walter and Eliz.a altho'
Solemnly Called Cometh not nor says nothing in barr or preclusion of the action afd of the afd Betty by
which the Same Betty Remaineth thereof against the afd Walter and Eliz.a undefended &.c

       Therefore it is Considered that the afd Betty Gale Recover against the afd Walter Jacob & Eliz.a his wife
        admrx of the afd Christopher Dashiell her debt afd and her damages by Occasion of the detaining of
361   the Same debt to three hundred & Sixty one                              pounds of tobacco to the Same
Betty of her assent by the Court here adjudged of the Goods and Chattells which were of the afd Christopher
Dashiell at the time of his death in the hands of the Same Walter Jacobs and Eliz.a to be administred
if so much in their hands they have & if so much in their hands they have not then the damages afd of
the proper goods & Chattells of the Same Walter & Eliz.a & ye same defts in mercy &.c
