124 hundred and thirty One Came againe as well the afd Nathaniel Brittingham as the aforesaid John Magan by their attorneys afd and whereupon the Said John Magan at the prayer of the said Nathaniel Brittingham by his attorney aforesaid is adjudged to Give Special Bail to the action afd thereupon a Certain John Harper of Somerset County planter present here in Court undertakes for the Said John Magan that if in Case the Said Nathaniel Brittingham shall recover Judgm.t in the plea afd against the Said John Magan or that the Said John Magan Shall be therein Convict that then he the Said John Magan Shall pay the Condemnation of of the Court thereupon or render his body to the Custody of the Sher of Somerset County in Satisfaction thereof or that he the Said John Harper will do it for him &c Whereupon the afd John Magan Says that he Cannot Gainsay the action aforesaid of the aforesaid Nathaniel Brittingham nor but that he did assume upon himselfe in manner and form as the aforesaid Nathaniel above against ^him^ hath Complained and as to the damage of the same Nathaniel by him by Occasion of the premisses in that part Sustained the Same John Says and Confesseth that the afd Nathall has sustained damages by occasion of the premisses further then his Costs and Charges by him about his Suit in that part apposed to five pounds Seven Shillings and four pence Currant money and not more and because the aforesaid Nathaniel denyes not this but the Same Allegation ^Confesseth^ to be true prays Judgm.t and those damages above Confessed together with his Costs and Charges afd to him adjudged Therefore it is Considered by the Consent of the parties aforesaid that the aforesaid Nathaniel Brittingham Recover against the aforesaid John Magan his damages aforesaid to the afd five pounds seven seven Shillings and four pence Currant money by the Same John in form aforesaid Confessed as also two hundred 253 and fifty three pounds of tobacco for his Costs and Charges aforesaid to the Same Nath.ll at his Request by the Court here and Consent of the parties afd adjudged with Stay of Execution till the twenty fifty day of december next and the afd deft in Mercy &c Ordered by the Court that Thomas Duncan pay unto Andrew Rathbourn Joshua Caldwell Thomas Caton and Brent Nuttall One hundred and twenty pounds of tobacco Each for their attendance four days Each ^as Evidence^ on behalfe of his Lordship against the Said Thomas Duncan they having made Oath to the Same &.c Ordered by the Court here that Samuel Riggin pay unto W.m Cox and Mary his wife Sixty pounds of tobacco Each for their attendance two days Each as Evidences for the Said Samuel Riggin against John Riggin Junr they haveing made Oath to the Same &c Ordered by the Court that John Riggin Jun pay unto John Riggin Sen one hundred ^and twenty^ pounds of Tobacco for his attendance four Days as an Evidence for the said John Riggin Jun against Sam.ll Riggin he having made Oath to the Same Ordered by the Court that John Riggin Jun pay unto Charles Riggin Teague Riggin and Peter Dickerson Sen one hundred and Fifty Pounds of Tobacco Each for their attendance five days Each as an Evidences for the Said John Riggin Jun against Sam.ll Riggin they having made Oath to the Same &c |
