123 or render his body to the Custody of the Sher of Somerset County in Satisfaction thereof or that they the Said Levin Gale, W.m Beckingham and Thomas Bluet will do the Same for him &c Whereupon the Said William Dulany in his proper person Comes and defends the force and Injury when &.c and Says that he Cannot Gainsay the action afd of the aforesaid Thomas nor Can he Say but that the writing Obligatory aforesaid is his act deed nor but that he owes the Same Thomas the aforesaid Seventeen pound ^ten Shill^ in manner and form as the afd Thomas above against him hath declared &c Therefore it is Considered that the aforesaid Thomas Nevett Recover against the aforesaid William Dulany Seventeen pounds tenn Shillings Currant money his debt aforesaid and his damages by Occasion of the detention of the Same debt to three hundred and Ninty Seventy three pounds of tobacco to the Same Thomas by the Court here 373 of his assent adjudged and the aforesaid W.m Dulany in Mercy &c with Stay of Execution untill Christmast Next
thirty One at Somerset County within the Jurisdiction of this Court was Indebted unto the Same Nathaniel in the Sum of five pounds Seven Shillings and four pence Currant money as P account may appear and so thereof being Indebted the said John in Consideration thereof afterwards to witt the same day and Year aforesd at the County aforesd and Within the Jur aforesd upon himselfe assumed and to the Said Nathaniel then and there faithfully did promise that when afterwards he Should be thereto requested he the said Sum of Five Pounds Seven Shillings and four pence to the Same Nathaniel would well and faithfully Content and pay Nevertheless the said John his promise and assumption aforesd in Forme aforesaid made Little regarding but Plotting and fraudulently Intending him the Said John In that part Craftilly and Subtilly to Deceive and Defraud he the Said John the aforesaid Sum of five Pounds Seven Shill.s and four pence nor any part thereof to the Same Nathaniel hath paid or him for it in any wise Contented altho' the Said John afterwards to witt the Same day and Year aforesaid at the County aforesaid and Within the ^afd^ Jur was thereto Requested by the Same Nathaniel but the said John the Same to do hath altogether refused and Still doth refuse wher^e^by the Same Nathaniel Says he is Worse and hath Damage to the Value of ten pounds fourteen Shill.s and Eight pence Like money and thereof he brings this Suit &c F Allen P Qur Pledges &.c Jn Doe R Roe And the Said John Magan by W.m Beckingham his attorney Comes and defends the force and Injury when &.c and prays Leave thereof to Imparle here untill the next Court and he hath it and the Same day is Given to the afd Nathaniel Brittingham here also &c Att which said next Court to witt the Seventeenth day of august ann Dom One thousand Seven hundred |
