he puts himself upon the Countrey &.a    And the plft.s in Like manner

             Whereupon the aforesd William by his Attorney aforesd
relinquisheth ^his verification^ aforesaid by him first above pleaded Says that he Cannot Gainsay the action afd
of the aforesaid Henry nor but that he did assume upon himselfe in manner and form as the afd Henry
above against him hath Complained and as the damage of the Same Henry by him by Occasion of
the premisses in that part Sustained the Same William Says and Confesseth that the afd Henry has
Sustained damages by Occasion of the premises further then his Costs and Charges by him about
his Suit in that part apposed to five hundred pounds of tobacco and not more and because the
the afd Henry deny's not this but the Same allegation Confesseth to be true prays Judgm.t and these
damages above Confessed together with the his Costs and Charges afd to him adjudged &c

                Therefore by consent of the parties aforesaid it is Considered by the Court here that the aforesaid Henry Spear
recover against the aforesaid William Whittington his damages ^to the afd five hundred pounds of tobacco^ aforesaid by the Said William in form afd
258    Confessed as also two hundred and fifty Eight                                    pounds of tobacco for his Costs and Charges
afd to the Same Henry at his request by the Court here and Consent of the parties aforesaid adjudged
and the afd defent.d in mercy &c

Somerset County ss     Solomon Townsend Late of Somerset County planter
was attached to answer unto William Holston of a plea of trespass
upon the Case &c
                                  And whereupon the Same William by James Shirly his attorney Complains for
that whereas the said W.m the Seventeenth day of Feburary Ann Dom
Seventeen hundred and thirty at Somrset County aforesd within the Jur
of this Court was passed of a bay horse of the price of twelve pounds Currant
Money of Maryland as of his own proper horse and being thereof so
possed the Same bay horse out of his hands and possicon Casually Lost
which same horse afterwards to witt the Same Seventh day of Febry in
the Year aforesd at Somrset County and Within the Jurisdiction aforesd to
the hands & posseson of the aforesd Solomon by finding did Come  Nevertheless
the aforesd tho' often thereunto requested to the said William hath
not Delivered but the bay horse afterwards to witt the tenth
