113 aforesaid Henry Allexander at the time of his death in the hands of the afd Rachell ^Alexander^ remaining to be Administred if so much in her hands she hath and if so much in her hands she hath not then the Costs aforesaid to be Levied of the proper Goods and Chattles of the aforesaid ^Rachell^ Whereof She is Convict as by the Records and Procedings thereof in our Same Court before our Justices at Dividing Creek aforesd Residing manifestly appeareth and afterwards the afd Rachell Took to her Husband A Certain John Newbold as by the Insinuation of the afd John Hendry in our Court before us at Dividing Creek we have received and altho' Judgment be thereof Rendred Execution of the Damages and Costs aforesd as Yett remaineth to be made whereof to us the same John Hendry hath Supplicated himselfe of approper remedy in that part to be provided and we in that part being willing to do that which is Just Command you that by honest and Lawfull men of your bailywick you make known unto the aforesd John Newbold and rachell his wife that they ^be^ before our Justices of our County Court of Somrset to be held at Dividing Creek the third tuesday of November Next to Shew Cause if any thing for themselves they have or know to say Wherefore the aforesd John Hendry his Execution against them of the Damages and Costs aforesd to have ought not of the goods and Chattles which were of the aforesd Henry Allexander at the time of his Death in the hands of the afd John Newbold and rachell remaining to be administred if so much thereof in their hands they have and if so much thereof in their hands they have not then the Costs aforesd to be Levied of the proper Goods and Chattles of the afd John Newbold and rechell his wife according to the form of the recovery afd if to them it shall ^seem^ Expediant and have you then and there the Names of them by whome to them you make the same known and this Writt Wittness Samuel Hopkins Gent Chief Justices of our said Court the twenty Second Day of Aug^u^st in the Sixteenth Year of our Dom &.c Ann Dom one thousand seven hundred and thirty Att which Said third tuesday of November to witt the Seventeenth day of the Same Month Anno Dom One thousand Seven hundred and thirty being the day of the return of the Said Writt Cometh the said John Hendry by his attorney afd and the Sherr of Somerset County to witt John Purnall Gent.m at the Same day Returned that by Virtue of the writt afd to him directed he had made known to the aforesaid John Newbold and Rachell his wife that they be before the Justices of his Lordships County Court of Somerset to be held at dividing Creek at the day |
