Command was given to the Sher of Somersett County that he should
Take John Webb Late of Somersett County planter if he should be
found in his Bailywick and him should Safe keep so that he might
have his Body before the Justices of his Lordships County Court of Somersett to be held at
dividing Creek the third tuesday of March then next to answer unto Jno Murray of a plea
of trespass upon the Case &.c   And that thereof he should not fail &c

       Att which said third tuesday of March to witt the Ninteenth day of the same Month
Ann Dom one thousand seven hundred and twenty seven being the day of the return of the said
writt Cometh the afd John Murray by his attorney afd and the sherr of Somersett County to whom
the foregoeing writt was directed Likewise Cometh and and Maketh Return thereof to the
Court here Endorsed in these words following vizt   Cepi Corpus P me Fran: Allen sherr

       Whereupon the said John Webb in his Own proper person appears and thereupon the
said John Webb at the prayer of the Plantifs attorney afd is adjudged to give Speciall Bail to
the action afd but for want thereof the Said Jn.o Webb is Committed into the Custody of the Sherr
of Somersett County thereto remaine &.c the Said Sherr present here in Court took Charge of the
Said Jn.o Webb accordingly &c      And afterwards in the Same Court Came here a Certain abraham
Smith of the County afd Planter and undertakes for the said John Webb that if in Case the afd
John Murray Shall Recover Judgm.t in the plea afd against the afd John Webb or that the said
John Webb shall be therein Convict that then he the said John Webb Shall pay the Condemnation
of the Court thereupon or render his Body to the Custody of the Sherr of Somersett County in Satisfaction
thereof or that he the Said Abraham Smith will do it for him thereupon the Said Jn.o
Webb is discharged from the Custody of the Sherr afd &c

           Whereupon the afd John Webb in his Own proper person Cometh and defendeth the force &
Injury when &.c and saith that he Cannot gainsay the plft his action afd against him brought nor
Can he Say but that the Said plft Ought to recover his damages by Occasion of the premisses afd to
five pounds two Shillings and five pence Curr mony and Costs of Suit against him which the
Said Plft doth not gain Say &c

                               Therefore it is Considered by the Court here the Ninteenth day of March
Ann.o Dom One thousand Seven hundred and twenty Seven that the afd John Murray recover against
the afd John Webb five pounds two Shillings and five pence Curr mony his damages afd in form
245    afd Confessed as also Two hundred and forty five                           pounds of tobacco for his
Costs and Charges by him about his Suit in that part Expended to the Same Jno Murray by the
Court here of his assent adjudged & the afd deft in Mercy &c
