afd Alexander in the plea afd to be given and nothing Els thereof saith by which the same
Alexander Remaineth against the afd John thereof undefended

             Whereupon the Justices here at the prayer of the afd Plft and by the Consent of
the afd defd do assess the damages of the same Plft by Occasion of the Nonperformance
of the promise and assumption afd (according to act of assembly in such Case made and
Provided) to twenty Two pounds Nine Shillings and Nine pence halfe Penny Curr.t mony
of Mary^land^ besides his Costs and Charges in that ^part^ Expended &c

             Therefore it is Considered by the Court here the Ninteenth day of March Anno
Dom One thousand seven ^hundred & twenty seven^ that the afd Alexander Woodrop recover against the afd Jno Hendrey
in Custody as afd Twenty two pounds Nine Shillings and Nine pence halfe Penny Curr.t mony
his damages afd by the Justices afd assessed as also four hundred and thirty pounds of
tobacco for his Costs and Charges by him about his suit in that part Expended to the same Alex.d
by the Court hereof his assent adjudged and the afd Defend.t in mercy &c

    Afterwards viz.t the same day and Year Last mentioned the said Jno Hendrey present here
in Court is at the prayer of the afd Alexander by his attorney afd Committed into the Custody of
the sherr of somersett County there to remain untill the afd Alexander of the damages and
Costs afd should be fully Satisfyed the said Sherr being present herein Court took Charge of
the said Jn.o Hendrey accordingly &c

memorand.m the plft by Levin Gale his attorney sued out his Lordships writt of
Scirefacias against the deft the tenor whereof followeth in these words viz.t

Somersett fs  Charles absolute Lord and proprietary of the provinces of
of maryland and avalon Lord Baron of Baltemore &c   To the sherr of Somersett County
Greeting Whereas a Certain Benj.a Wailes Late of Somrsett County Gent Lately in our
Co.ty Court of Somrsett here (to witt) the fifteenth day of March Ann.o Dom one thousand
Seven hundred & twenty five before Saml Hopkins & his associates then our Justices at
Dividing Creek in our Co.ty afd assumed upon himselfe & did undertake for a Certain James
Scott Late of Somrsett Co.ty Marriner that in Case a Certain Andrew Scott Should recover Judgment
against the afd James in a Certain Plea of trespass upon the Case by the
Same Andrew against the afd James in our Same Court Prosecuted or that the said
James Should be therein Convict that then the same James all the Damages which to
the same Andrew in our Same Court herein the afd Plea of trespass upon the Case &c
that should be adjudged would Satisfie on his body in Execution of Such Judgm.t to the sher
of Somrsett Co.ty would render or that he the said Benj.a Wailes would do the same for
him & altho the afd Andrew afterwards to witt the Sixteenth day of November Ann.o Dom
One thousand Seven hundred & twenty Six in our Same Court here before the same
Sam.l Hopkins Gent & his associats then our Justices of Somrsett Co.ty Court at Dividing
Creek afd & by Consideration of the Same Court recovered against the afd James
three pounds Eight shills & Nine pence Curr.t mony & three Hundred & Ninty ^Eight^ pd.s of
