                        John Evans sen.r Late of Somersett County planter
was attached to answer unto Daniel Caroll of a plea of trespass upon
the case &c
       And whereupon the Same Daniel by Levin Gale his attry Complaines that
       Whereas the afd John the tenth day of November Anno Dom one thousand Seven
       hundred and twenty Six at Somrsett Co.ty within ye Jur of this Court was Indebted
       to ye Same Daniel in the Sum of five pd.s Fourteen Shill.s & one peny Curr.t
       Mony as P account thereof May appear & so thereof being Indebted ye s.d Daniel
       in Consideration thereof afterwards to witt ye Same Day & year afd at ye Co.ty
       afd & within the afd Jur upon himselfe assumed & to the same Daniel then &
       there Faithfully Promised yt he When afterwards he Shou'd be thereto reque
       Requested he the afd sum of Five pounds Fourteen Shill.s & one Penny
       Curr.t Mony to ye Same Daniel would well & Faithfully Content and pay Nevertheless
       ye Said Jn.o his Promise & assumption afd in form afd made not regarding
       but Plotting & Fraudulently Intending him ye Same Daniel in yt part Craftilly
       & Subtilly to Defraud & Deceive ye afd five pd.s fourteen Shill.s & one penny Curr.t
       Mony or any part thereof to ye Same Daniel he hath not paid although ye
       same to doe the afd Jn.o afterwards viz.t ye same day & year afd at ye County
       afd & within ye af Jur by ye Same Daniel was Requested but he ye Same
       hither to to doe hath altogither refused & Still doth refuse whereby ye same
       Daniel sayes he is Worse and Hath Damage to ye Value of Seven pd.s Like
       Mony & thereof he Brings this Suite &.a       L Gale P Quer pledges &.a  J Doe R Roe

          And the afd Jn.o Evans by Geo: Dashiell his attry Comes & Defends the force and
       Injury when &.c and prays Leave to Imparle hereunto untill the Next Court
       & he hath it and the same day is given to the afd Plft here also &c

          Att which said Next Court to witt ye fifteenth day of August Anno Dom one
       thousand Seven hundred & twenty Seven Came again as well the afd Daniell
       as the afd Jn.o by there attrys afd & whereupon ye said Jn.o by his said attorney
       prays Further Leave ^thereof^ to Imparle hereunto untill the Next Court & he hath
       it and the same Day is given to ye afd Plft here also &a

          Att which said Next Court to witt ye twenty first day of Novem.r Ann.o Dom
       one thousand Seven hundred & twenty Seven Came again as well ye afd Daniell
       as the afd Jn.o by there attrys afd and whereupon the same attorney of the
       Same Jn.o as before Defends the force and Injury when &.c & saith yt he
       Cannot gainsay ye action afd of ye afd Daniel nor Can he say but yt ye afd Jn.o
       did assume upon himselfe in Manner & form as ye afd Daniell above against
       him hath Declared nor but y.t ye said Jn.o Evans ^was^ thereof Declared the afd
       Five pd.s Fourteen Shill.s & one penny Curr.t Mony & ye Declaration in all
       the words before Expressly Confesetth &a

         Therefore it is Considered by the Justices here ye Same Day and year
