    August Court            1727                           39

Wailes in his Lordships County Court of Somersett before the Justices thereof at Dividing Creek
Recovered against ye said W.m as Five hundred and fifty Six pounds of tobacco which to the
same Benja in the same Court were adjudged for his Costs and damages which he had by
Occasion of the detaining of the Same Debt is also two hundred and fifty four pds of tobacco
which to the same Benj.a were adjudged ^for his Damages^ according to the form of the statute thereof made
and provided ^which he^ Sustained by Occasion of delay of Execution of the debt and Damages afd if the
afd Jn.o Blizard hath so Much goods and Chattles which were of the afd W.m at ye time of his death
in his hands Remaining to be administred & if so Much in his hands he hath not then the
Costs afd of the proper goods & Chattles of ye said Jn.o Blizard to Levied & yt he have ye same before
the Justices of his Lordships Co.ty Court of Somrsett the third tuesday of August then Next
to render the afd Benj.a of his ^Debt^ Dams and Costs afd &a

Att which said third tuesday of August to witt ye fifteenth day of the same Month Ann.o Dom
one thousand seven hundred and twenty Seven Comes the afd Benj.a Wailes by Levin Gale
his attry & ye Sher of Somrsett Co.ty to whom the foregoing writt was Directed Likewise Cometh
and Maketh return thereof to ye Court here Endorsed Vizt  The Execution of this Writt
appears in a Certain Schedull to ye same Annexed                  Fran Allen Sher

A Schedull of ye goods & Chattles of W.m Pepper late of Somrsett Co.ty dec.d in ye hands of Jno Blizard
Ex.r of the Last will & Testam.t of ye same W.m for ye use of M.r Benj.a Wailes & appraised
by us ye Subscribers  Given under our hands & seals this 21st day of July anno Dom 1727
