265 for the County of Somersett in the province of Maryland the above named Samuel Hopkins Jun.r and made Oath upon the holy Evangelist of Almighty God that the above account is Just and true and that he hath not nor any one for him to the best of his knowledge Received any part or percell thereof and that he is Credibly Informed the above Peirce Dant is not Lately and actually [illegible] & hath removed and Caried away a great Part of his Substance with Intent to deceive his Creditors and fly from Justices as wittness my hand y.e day and year above M.r Hayward The above named Samuel Hopkins Jun.r having made Oath as above before me Issue attachment for the above debt due to him against the Effects of Peirce Dannt late of Somersett County merchant Pursuant to act of assembly &.c May 25.th 1730 To Mr Thomas Hayward Cler of Somrsett Coty These Pursuant to an act of assembly in such Case provided the following ^at^tachment was Issued against the Effects of the aforesaid Peirce Dannt the tenor whereof is in these words vizt Somersett ss Charles absolute Lord and Proprietary of the provinces of Maryland and avalon Lord Baron of Baltemore &.c To the sher of Somersett County Greeting we Command you that you attach any the goods or Chattells Rights or Creditts of of Peirce Dannt late of Somerset County merchant if they shall be found in your bailywick to the value of fourteen pounds Eight shill.s Currant money and five hundred pounds of tobacco and when you have the Same so attached or any part thereof the Same in your Custody safe Keep so yt you have them before y.e Justices of our Co.ty Co.t ^of Somersett^ to be held at Dividing Creek y.e third tuesday of June Next then & there to be Condemned According to Act of assembly to & for the use of a Certain Sam.l Hopkins Jun.r unless the said Peirce Dannt by himselfe or his attry Shall appear & answer unto the said Sam.l Hopkins Jun.r in a plea of trespass upon y.e Case &.a According to Law & that by Good & Lawfull Men of Your Balywick You Make Known unto y.e Person or Persons in whose hands you Make the Same Attachm.t that he She or they be & appear before y.e Justices of our Co.ty Co.t to be Held as afd to shew Cause if anything they he she or they have whey y.e same Goods Chattles rights or Creditts so attached in his her or their Hands Ought Not to be Condemned & Execution thereof Had & Made According to the form of the Act of assembly in Such Case Made & Provided of to him her or them it Shall Seem Mete & How you Shall Execute this Writt that You Make Known unto our said Justices at y.e Day & Place afd & have you then & there this Writt Wittness Will.m Planner Gent one of our Justices of our s.d Co.t y.e twentyeth Day of March in the fifteenth Year of our Dominion &.c Ann.o Dom.r one thousand Seven Hundred and twenty Nine Att which said third tuesday of June to witt the Sixteenth day of the Same month Anno Dom One thousand seven hundred and thirty being the day of the return of the said Writt Cometh the Said Samuel Hopkins in his Own proper person and the Sher of Somersett County ^whom y.e^ writt in the Same action was directed ^likewise^ Came and made returne thereof as followeth viz.t By Vertue of the within writt to me directed I have attached of the Goods of Peirce Dannt Four hundred Forty two pounds of tobacco also one three Years old stear of the Value of two hundred and fifty pounds of tobacco in the within Named Samuel Hopkins Own hands to be Condemned for his Use &.c as by the within Writt I am Commanded before Littleton Townsend and John Doe good and Lawfull men of my bayliwick John Purnall sher Whereupon the said Samuel Hopkins prays that the afd Four hundred and forty pounds of tobacco and ^one^ three years old stear of the value of two hundred and fifty pounds of tobacco so as afd attached as of the Rights and Creditts of the afd Peirce Dannt may be Condemned for his Use towards satisfying ^him^ of the afd fourteen pounds Eighteen Shillings Currant money and all Costs accrewing upon the attachment afd &.c Therefore it is Considered by the Justices here that the afd Sum of four hundred and forty pounds of tobacco and One three Years old Stear of the Value of two hundred and fifty pounds of tobacco so as afd attached as of the rights and Creditts of the afd Peirce Dannt ^be Condemned^ towards Satisfying unto the said Sam.l Hopkins as well the ^afd^ Sum of fourteen pounds Eighteen shillings Currant money as all all Costs accrewing upon the writt of attachment afd and that the afd Samuel Hopkins have thereof his Execution according to act of assembly &c |
