the same John sold and delivered and money paid for his Use at his request as by account herewith in Court produced
may appear and also in the sum of Eight thousand pounds of tobacco for the like Sum of Sundry
persons before that time for the Use of the same John rec.d and so thereof being Indebted the said
Francis In Consideration thereof afterwards to witt the same Day & Year afd at the Co.ty afd and
within the afd Jur upon Himselfe assumed & to the Same Jn.o then & there faithfully did
Promise that he when afterwards he shou'd be thereto requested he the said Sums of
fifty two Pounds twelve Shillings & two Pence Curr.t Mony of Maryland & Eight thousand
Pounds of tob.o unto the same John wou'd well & faithfully Content & Pay Nevertheless
the same Francis his Promise & assumption afd in form afd Made Little regarding
But Plotting & fraudulently Intending him y.e same Jn.o in that Part Craftilly and
Subtilly to Defraud & Deceive he the afd Sum of fifty two Pounds twelve Shillings
& two pence Curr.t Mony of Maryland & Eight thousand pounds of tob.o or any Part thereof
unto the Same John hath not Paid or him for it in anywise Contented altho' y.e same Francis
the Same to doe afterwards that is to say the tenth day of June Ann.o Dom.r one thousand
Seven Hundred & twenty Eight at Somrsett Co.ty afd within y.e afd Jur was thereto by y.e
Said Jn.o requested but y.e said Francis the same hitherto to doe hath altogether refused and
Still doth refuse whereby the same John say's he is worse & Hath Damage to the Value
of Sixty pounds Curr.t Mony & Nine thousand pd.s of tobo & thereof he Brings this Suite

Seven Hundred and twenty Eight Came Again as well the afd Jn.o Tunstall by Levin Gale

further Leave to Imparle hereunto untill the Next Court and he Hath it and y.e same

Seven Hundred & twenty Nine Came Again as well the afd Jn.o Tunstall by Levin Gale his
attry as y.e afd Francis Allen in his Own Proper Person and the said Francis Allen Prays farther
Leave to Imparle hereunto untill the Next Court & he hath it & the same Day is Given to
the afd Plft here also &.a

       Att which said Next Co.t to witt the Nineteenth Day of August Anno Dom.r one thousand
Seven Hundred & twenty Nine Came Again as well the afd Jn.o Tunstall by Levin Gale
