we have appointed you or any three or two of you to be our Commissioners to Examine Evidences of on behalfe of a Certain William Fasitt Jun.r of the County afd Gent in relation to the bounds of a tract of Land Lying on the seaside in ye Co.ty afd Called Unity We therefore require You or any three or two of You that at Some time or place as to You or any three or two of you Shall Seem Convenient You Meet on ye afd Land Called Unity (You first haveing taken Your Oath on the Holy Evangelist of Almighty God According to Act of assembly in Such Case Made & Provided) & there Cause to Come Before You or any three or two of You all Such Evidences as Shall be to You or any three or two of You Nominated by ye s.d Complanient (or Deft if Any) & Y that You Examine them upon their Corporall Oaths to be by You or any three or two of You Administred on ye Holy Evangelist of Almighty God in ye presence of ye Complanient (or Deft if any) touching ye truth or remembrance of their Knowledge or anything y.t May relate to ye Cause afd & yt reduceing ye severall Depositions into Writing you send ye same together with this our Commission under Your or any three or two of Your Hands to us to our Co.ty Co.t of Somrsett with all Convenient Speed Wittness Samuel Hopkins Gent Chief Justice of our s.d Co.t &.a On ye Backside of ye foregoing Commission it was thus Endorsed vizt Maryland ss: These are to Certifie yt Jn.o Donelson & Isaiah Bredall two of ye within Commissioners were duly Quallified as ye Law directs Before me one of his Lordships Justices for Somrsett Co.ty ye twelfth day of March 1728/9 W.m Fasitt Somrsett ss: We ye subscribers two of ye Commissioners appointed by ye Worshipfull ye Justices of Somrsett Co.ty To Examine Evidences on Behalfe of a Certain Willim Fasitt Jun.r of ye Co.ty afd Gent.m in relation to ye Bounds of a tract of Land Lying on ye seabord side in ye Co.ty afd Called Unity Being Quallified as ye Law directs Mett on ye afd Land ye 21.st Day of March 1728/9 Where Came Before us Cap.t W.m Fasitt aged about Sixty Six Years & being Sworn upon ye Holy Evangelist of Almighty God (We being then by ye side of a Locust post Stuck in ye Ground on ye side of a Small hill Near ye Orchard of Charles Collins on ye South East side of ye same) that According to ye Best of his Knowledge this Deponant Saw ye first Bounder of ye afd tract of Land Called Unity Standing Near ye Place where ye afd Locust Post Now Stands & further this Deponant Says that a Certain W.m Tompkins who was ye first taker up of a Certain tract of Land Called Burley (of which ye afd tree Standing Near ye Place or where ye afd Locust Post Now Stands was a Corner tree) told ye s.d Deponant a Certain Jn.o White when he was takeing up ye afd Land Called Unity desired Leave of ye afd Tompkins to Joyn Bounders which ye s.d Tompkins refused But yt Some time after ye s.d Tompkins told this Deponant they had Joyned Bounders & further Saith Not At ye same time & Place also Came Before us Tho.s Collins Aged about (thirty) |
