within ye afd Jur upon himselfe assumed & to ye Same Jos: then & there faith
fully Promised yt he ye said Robert when afterwards he Should be thereto
requested ye afd sum of Eight Hundred & fifty three pounds of tob.o unto
the same Jos: he would well & faithfully Content & Pay Nevertheless ye afd
Robert his Promise & assumption afd in form afd Made Little regarding but
Plotting & fraudulently Intending him ye said Jos: in yt part Craftilly and
Subtilly to Defraud & Deceive he ye afd Sum of Eight Hundred & fifty
three pds of tob.o nor any part thereof unto ye same Jos: hath not paid or
him for it in anywise Contented altho' ye said Robert ye same to Doe
thereto requested but ye said Robert ye same hitherto to do hath altogether refused
& Still Doth refuse Whereby the Same Jos: Say's he is worse & hath
Damage to ye value of two thousand pounds of tob.o  And thereof he brings
this Suite &.a         Levin Gale P Quer Pledges &.a  J Doe Rich.d Roe

           A Copy of the foregoing Declaration & Acc.t was Made and Sent to be Servered on
the Deft with the Writt in the Plea afd

               Att which said ^third tuesday of March^ Next Court to witt the Seventeenth Day of March ^the same month^ Ann.o Dom
One thousand Seven Hundred and twenty Nine being the ^day of the^ return of ye said Writt
Cometh ye said Jos: MaClester by his attry afd and the Sher of somrsett Co.ty to Whom
ye foregoing Writt was directed Likewise Cometh & Maketh return thereof to the
Court here Endorsed viz.t   Cepi Corpus declaration delivered in time P Jn.o Purnall sher

              Whereupon ye said Robert Watson in his Own Proper Person Comes and defends
ye force & Injury When &.a  And says that he Cannot Gainsay ye Action afd of ye afd
Jos: Nor but that he did assume upon himselfe in Manner & form as ye afd Jos:
above against him hath Complained & as to ye Dam of ye said Jos: by him by Occasion
of ye Premisses in yt part Sustained ye same Robert says & Confesseth yt ye afd
Jos: Has Sustained Damage by Occasion of ye Premisses beyond his Costs and
Charges by him about his Suite in that Part apposed to Eight Hundred and
fifty three pounds of tob.o & Not More & because ye afd Jos deny's Not this but
ye same Alligation Confesseth to be true Pray's Judgm.t & those Damages above
Confessed together with his Costs & Charges afd to him adjudged &a

             Therefore it is Considered by Consent of ye Parties afd that the afd Joseph
MaClester recover against the afd Robert Watson Eight Hundred & fifty three
Pounds of tob.o His Damages afd by the Same Robert in form afd Confessed
                                                                                                          (as)
