24 Jane say that he is not Informed by the same John and Jane his Clyants of any answer for the Same John and Jane to the afd William Alexander in the plea afd to be given and nothing Els thereof says by which the same plft Remaineth against the afd Defts thereof undefended &c wherefore the afd William his Damages by Occasion of the premisses against the afd John and Jane ought to recover Whereupon at the prayer of the afd William Alexander and by the Consent of the afd John and Jane the Justices here according to act of assembly in such Case made and provided do assess the damages of the same William by occasion of the premisses besides his Costs and Charges by him about his Suite in that part Expended to seven pounds sixteen shillings sterling money &c Therefore it is Considered by the Court there that the afd William Alexander Recover against the afd John Handy and Jane his wife Executrix of the same John Winder as well the sum of seven pounds Sixteen shillings Sterr money his damages afd by the Justices afd in form afd assessed as 301 also the sume of three hundred & One pounds of tobacco for his Costs and Charges by him about his suite in that part Expended to the same William by the Court here of his assent adjudged to be Levied of the Goods and Chattells ^which were^ of the afd John Winder at the time of his death in the hands of the afd John and Jane to be administred if so much in their hands they have and if so much in their hands they have not then the Costs afd to be Levied of the proper goods and Chattells of the same John and Jane &.c and the afd deft in Mercy &c
Ebenezer ye Sixth day of March Anno Dom one thousand seven hundred & twenty Seven at Somrsett Co.ty within the Jur of this Court by his Certain Writing Obligatory Granted himselfe to be held and firmly Bound unto ye same Francis in ye sum of Eight Thousand pd.s of Tob.o to be paid the same Francis When afterwards ye said Ebenezer Shoud be thereto required Yet ye afd Ebenezer though often thereto required ye afd Sum of Eight Thousand pd.s of Tob.o to ye same Francis hath not Rendered but ye said Ebenezer the same hitherto to doe hath altogether Denyed & Still doth Deny & unjustly detain whereby the same Francis sayes he is worse & hath Dam to ye Value of Sixteen thousand pounds of Tob.o & thereof he Brings this Suite &c And ye Same Francis brings hereinto Court the Writing obligatory afd which ye Debt afd in form afd Wittnesseth whose Date is ye same day & year afd Levin Gale P Quer Pledges &.c Jno Doe Richd Roe And the afd Ebenezer Seamore by George Dashiell his attorney Comes and defends the force and Injury when &c and prays Leave to Imparle hereunto untill the Next Court and he hath it and the same day is given unto the afd plft here also &c Att which said next Court to witt the fifteenth day of august anno Dom one thousand seven hundred |
