of the Last will and Testam.t of Jno Winder Late of Somersett County Gent
Dec.d were attached to answer unto Wm Alex.d of a plea of trespass
upon ye Case &c                       And whereupon ye same W.m Allexander
                                     by Levin Gale his attorney Complaines that whereas a Certain Fran Kanner
       ye sixteenth Day of March Anno Dom one thousand seven hundred Ten at Somrsett Co.ty afd
       within the Jurisdiction of this Court useing Trade & Comerse According to the Custom of Marchants
       and Others of this the Province of maryland and Citty of London In England of old used
       Made & Drew his third Bill of Exchange with his proper hand subscribed bearing date
       the day and Year afd or to a Certain Jno Tucker merchant in Barnstable in ye Kingdome
       of England residing and Negotiating Directed and by the said BIll requested ye said Jno Tucker
       thirty days after sight thereof his first nor second being Paid to pay unto ye afd Jno Winder
       or his Order the Sum of five pd.s ten Shill.s Sterll Mony of Great Brittain which said Bill
       afterwards to witt the same day and Year afd at the County afd within ye afd Jurisdiction and
       Before sight thereof by the afd Jno Tucker had the afd Winder in his Lifetime by Indorsmt
       with his Proper hand Superscribed According to the Custome of Merchants afd Order'd to be
       Paid to the order of the afd Will.m Allex.d for Value received of which said Indorsm.t the
       said Jno Tucker afterwards to wit ye Seventh Day of June Anno Dom one thousand Seven
       hundred and fifty at Barnstable viz.t in Somersett County within the Jur of this Court
       had Notice and then and there was requested to pay the said sum of five pd.s ten Shill.s
       Sterr to the Order of ye said Will.m Allexd and the same W.m Allex.d in fact saith that
       the afd Jn.o Tucker after Thirty days Sight of the afd third Bill of Exchange & Notice ^as^ afd
       hither to hath not paid the afd Sum of five pd.s ten Shill.s to him the said William or his
       order and that for warrant of paym.t thereof the Said third Bill of Exchange afterwards
       to witt the twentieth day of July Anno Dom one thousand Seven hundred and fifteen was by
       the ^order of the^ said Will protested or Caused to be protested the first and Second of the same term & date
       Not Being paid According to the Custom of Merchants afd whereof ye same Jno Winder in his Life
       time afterwards to witt the tenth day of Octob.r Anno Don one thousand Seven hundred and
       fifteen at the County afd and within the afd Jur had notice and in Consideration thereof &
       the Custom of Merchants afd upon himselfe assumed & to the said William then & there faithfully
       Promissed that he when afterwards he should be thereunto Requested he ye afd Sum of five
       Pounds ten Shill.s sterr to the Same William Allex.d would well & faithfully Content & Pay
       Nevertheless the same Jno Winder in his Life time and the afd Jane Since his Death
