228 deny whereupon he says he is worse and hath damage to the value of Six pounds Curr.t mony of maryland aforesaid and thereof he brings Suit &c F Allen P Qur pledges dep Jno Do R Roe
A Copy of the foregoeing declaration and account were made and sent to be served on the defend.t with the writt in the plea afd Att which said third tuesday of November to with the twenty fourth day of the same month anno Dom One thousand seven hundred and twenty Nine being the day of the return of the said writt Cometh the said Thomas Outerbridge by his attorney afd and the sher of somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed in these words following viz.t Cepi Corpus decl delivered in time P Jno Purnall sher And the said Henry Smith in his Own proper person Comes and defends the force and Injury when &.c and saith that he Cannot gainsay the action afd of the afd Thomas nor but that he did assume upon himselfe in manner and form as the afd Thomas above against him hath Complained wherefore the afd Thomas his damages by Occasion of the non performance of the promise and assumption afd against the afd Henry Ought to recover but because it is not known what damages the afd Thomas has sustained by occasion of the non performance of the promise and assumption afd Command is to the sher of somersett County that by the Oath of honest and Lawfull men of his bailywick or County 216 he diligently Enquire what damage the afd Thomas has Sustained as well by Occasion of the non performance of the promise and assumption afd as for his Costs and Charges by him about his Suit and that part apposed and the Inquisition which thereof he takes to his Lordship's Justices at the Next Court to be held at dividing Creek the third tuesday of March next under his seal and the seales of those by whose Oath he takes the same Inquisition he send with his said Lordships writt to him thereof directed and the the same day is given to the afd Henry three also &c
Court was Indebted unto the afd John Hendry in the sum of forty two pounds four shillings and five |
