   Recover against the afd William West two pounds fifteen shillings and one penny Curr.t mony his
damages afd by the Same William in form afd Confessed as also Two hundred and sixty
239   pounds of tob.o for his Costs and Charges afd to the Same Vachell at his request by the Court here by Consent
of the parties afd adjudged which Certain Damages in the whole do amount to two pounds fifteen shillings
and one penney Curr.t mony and                                                                  pounds of tobo & ye afd defendts
in mercy &c

 Somrsett ss  William Miles Late of Somrsett Co.ty Planter was attached to answer
unto Jos MaClester of a plea of trespass upon the Case &c
And whereupon the same Jos by Levin Gale his attry Complains that
                whereas the afd Will.m the tenth Day of Novem.r Ann.o Dom one thousand Seven
Hundred & twenty Six at Somrsett Co.ty within the Jur of this Court was Indebted unto
the Same Joseph in the Sum of Eight Hundred & thirty Eight pounds of tob.o as by an
Acc.t referrence thereunto being had may More fully appear & so thereof being Indebted
the Same Will.m in Consideration thereof afterwards to witt the Same Day & year afd at
the County afd & within the afd Jur upon himselfe assumed & to the Same Jos then & there
faithfully Promised that he when afterward he Should be thereto requested he the afd Sum
of Eight Hundred & thirty Eight pounds of tob.o to the Same Jos wou'd well & faithfully
Content & Pay Nevertheless the Said Will.m his Promise & assumption afd in form afd
Made Little regarding but Plotting & fraudulently Intending him the Said Jos in that
part Craftilly & Subtilly to Defraud & Deceive he the Said W.m the Said Sum of Eight
Hundred & thirty Eight pounds of tob.o nor any part thereof to ye Same Jos hath not
Paid altho' the Same to do the Sid Will.m afterwards to witt the Same Day & year afd at ye
Co.ty afd & within the afd Jur was requested but he ye Same to do Hath altogether refused
& Still doth refuse Whereby the Same Jos Says he is worse & hath Damage to the value
of Sixteen Hundred & Seventy Six pounds of tob.o & thereof he Brings this Suite &c
                                                                L Gale P Quer  Pledges &c  Jno Doe R Roe

       Whereupon the said W.m Miles in his own Proper Person Comes & Defends the
force and Injury when &c  And Says that he Cannot Gainsay the Action afd of the afd Jos:
Nor but that he did assume upon himselfe in Manner & form as the afd Joseph above
against him hath Complained & as to the Damage of the Same Joseph by him by occasion
of the premisses in that part Sustained the Same William Says & Confesseth that the afd
Joseph has Sustained Damage by Occasion of the premisses beyond his Costs & Charges
by him about his Suite in that part apposed to Eight Hundred & thirty Eight pounds
of tob.o & Not More ^and^ because the afd Jos Deny's Not this but the Same alligation Confesseth
to be true prays Judgm.t & those Damages above Confessed together with his
Costs & Charges afd to him Adjudged &c

                      Therefore it is Considered by Consent of the Parties afd that ye afd Jos MaClester
Recover against the afd W.m Miles Eight Hundred & thirty Eight pounds of tob.o his Damages
afd by ye Same Will.m in form afd Confessed as also Two hundred & one
201   pounds of tob.o for his Costs & Charges afd to ye Same Jos at his request by ye Court here by
Consent of ye parties afd Adjudged which Certain Damages in the whole do amount to One
thousand and thirty Nine pounds of tob.o and                                                   pounds of
tob.o & the afd Deft in Mercy &c
