and Twenty Seven at Somersett County within the Jurisdiction of this Court was Indebted unto the Same Vachell in the Sum of two pounds fifteen shillings and one penny Curr.t mony upon the Ballance of an acco.t herewith in court produced and so thereof being Indebted the Said William in Consideration thereof afterwards to witt the Same day and Year afd at the County afd and within the afd Jurisdiction upon himselfe assumed and to the said Vachell then & there faithfully promised that he when afterward he should be thereto requested he the afd Sum of two pounds fifteen Shillings and One penny Curr.t mony to the same Vachell would well and faithfully Content and pay Nevertheless the said William his promise and assumption afd in form afd made Little Regarding but plotting and fraudulently him the said Vachell in that part Craftilly and Subtilly to defraud and deceive he the afd Sum of two pounds fifteen shillings and One penny Currt mony or any part thereof to the Same Vachell hath not paid or him for it in any wise Contented altho' the said William the Same to do afterwards to witt the Same day and year afd at ye County afd and within the afd Jurisdiction ^was^ way thereto requested but he the Same to do hitherto hath altogether refused and Still doth refuse whereby the Said Vachell says he is worse and hath damage to the Value of five pounds Curr.t mony and thereof he brings this Suit &c L Gale P Que Pledges &c Jno Do R Roe Whereupon the afd William West appears and thereupon the said William West at the prayer of the afd Vachell by his attorney afd is adjudged to give Speciall Bail to the action afd thereupon a Certain Randall West of Somersett County planter present here in Court undertakes for the said William West that if in case the said Vachel Denton should Recover Judgm.t in the plea afd against the Said William West or that the Said William West shall be therein Convict that then he the Said William West shall pay ye Condemnation of the Court thereupon or render his body to the Custody of the sher of Somersett County in Satisfaction thereof or that he ye Said Randall West Will do it for him Whereupon the Said William West by francis Allen his attorney Comes and defends the force and Injury when &c and Says that he Cannot gainsay the action of afd of the afd Vachell nor but that he did assume upon himselfe in manner and form as the afd Vachell above against him hath Complained and as to the damage of the same Vachell by him by occasion of the premisses in that part Sustained the same William Says and Confesseth that the afd Vachell has Sustained damage by occasion of the premisses beyound his Costs and Charges by him about his Suit in that part apposed to two pounds fifteen shills and One penny Currt mony and not more and becaus the afd Vachell Denys not this but the Same alligation Confesseth to be true prays Judgmt and those Damages above Confessed together with his Costs and Charges afd to him adjudged &c Therefore it is Considered by Consent of the parties afd that the afd Vachell Denton Recover |
