212 you at Some time & place as to you or any three or two of you Shall seem Convenient you Meet on ye afd Land Called Come by Chance & High Suffolk (you first haveing taken your Oath on the Holy Evangelist of Almighty God According to Act of assembly in Such Case made & provided) & there Cause to Come before you or any three or two of you all Such Evidences as Shall be to you or any three or two of you Nominated by the said Complaniant (or Deft if any) & that you Examine them upon their Corporall Oaths to be by you or any three or two of you Administred on ye Holy Evangelist of Almighty God in presents of ye Complanient (or Deft if any) touching ye truth or remembrances of their Knowledge or any thing that may relate to ye Cause afd & that reduceing the Several Depositions into Writing you send the Same together with this our Commission under your or any three or two of your Hands to us to our Co.ty Co.t of Somrsett with all Convenient Speed Wittness Sam.l Hopkins Gent Chief Justice of our S.d Co.t &c On the Backside of the foregoeing Deed it was thus Endorsed viz.t The Execution of the within Commission will appear by a Schedule hereunto Annexed Jn.o Caldwell Maryland Jn.o Handy Somrsett Co.ty ss: These are to Certifie that we the Subscribers Isaac Handy by vertue of a Commission out of Somrsett Co.ty Co.t to Examine Evidences to Prove the Bounds of four Hundred Acres Land belonging to Francis Lancake being a part of two tracts of Land Belonging to Adam Heatch ye one Called Come by Chance ye Other High Suffolk which Commission Issued at ye prayer of ye afd Francis Lancake bearing Date ye 19.th Day of June 1729: And According to Act of assembly we did Sett up our Notifications under our Hands at Stepney Parrish Chuch about thirty Days before we Meet on Said Lands & Haveing appointed by ye Said Notification to Meet on Said Land ye Last friday in July 1729: & Accordingly did Meet on said friday the Evidences not appearing appointed the Next Munday Following & Accordingly did Meet on ye Said Next Munday Following and Haveing Sumoned Robert Givans Thomas Humphris Jn.o Caldwell and Jn.o Cawdrey we did proceed as may appear by their Severall Depositions hereunto Annexed Given under our Hands this 28.th Day of July 1729 Jn.o Caldwell Jn.o Handy Somrsett County: Isaac Handy The Deposition of Rob.t Givans aged about fifty Eight years being Sworne one ye Holy Evangelist of Almighty God Saith as followeth that about Eight years past he was Imployed by Adam Heatch to Survey & Lay out four Hundred Acres of Land for Francis Lancake & that this Dead Gum Stump Standing by a Mulbery post Marked with Sixteen Notches & a large Stooping white Oak Near ye fork of a Glad & about one Hundred yards to ye Southerd of Jn.o Prices House is the third Bound.r of ye s.d Land Laid out for the S.d Lancake this Depon.t further deposeth y.t he run with a Straight line of Marked trees to ye first Bound.r being a marked white Oak on ye East side of ye Hand of Rockawakin Mill Branch being a bounder of Jn.o Cordrey's Land Sold him by Adam Heatch & Laid out and ye Same time by this Depon.t & further Saith Not Taken before us the Subscribers this 28.th Jn.o Caldwell Day of July 1729 Jn.o Handy Isaac Handy Somrsett Co.ty The Depos^i^tion of Tho.s Humphris aged about forty four years being Sworn on ye Holy Evangelist of Almighty God (Saith) |
