       And the afd Will.m Whittington in his own Proper person Comes & Defends
the force & Injury when &.c  And Prays Leave to Imparle hereunto untill ye Next
Court & he hath it & ye Same Day is Given to the afd Plft here also &c

             Att which said Next Co.t to witt the Ninteenth day of August anno Dom One thousand
      seven hundred and twenty nine Came again the afd Francis Mercer by his attorney afd and the said
francis prays that the afd William Whittington to his decl afd may answer  Whereupon the afd
William Whittington hath day given him by the Court here untill the second day of this term to answer
&c  And the same William at the same day being Solemnly Called to answer Cometh not nor Says
nothing in bar or Preclusion of the action afd by which the same same francis Remaineth
against the afd William thereof undefended &.c

                      Wherefore the afd Francis Mercer his damages by Occasion of the Non performance
of the promise and assumption afd against the afd William Ought to Recover &c

                         And whereupon at the prayer of the afd Francis Mercer the Justices here
according to act of assembly in such Case made and Provided do assess the damage of the
same francis by Occasion of the Non performance of the promise and assumption afd besides
his Costs and Charges by him about his Suit in that part Expanded to twenty two pounds
fifteen shillings and five pence Curr.t mony

                             Therefore it is Considered that the afd Francis Mercer Recover against ye
afd William Whittington his damages afd to twenty two pounds fifteen shillings and five
pence Curr.t money in form af by the Justices assessed as also three hundred & forty four
344   pounds of tobacco for his Costs and Charges to the Same francis at his request by the Court
here adjudged and the afd deft in mercy &c
