206 John Howsman have his Execution against the afd John Liptrott for six pounds Curr.t money and three hundred and Eight pounds of tobo his damages afd according to the force form and Effect of the Recover afd &.c Likewise the afd John Housman according to the form of the Statute in such Case Lately made and Provided Recover against the afd John Liptrott Two hundred and three pounds of tobacco for his Costs and Charges and damages which he Sustained by Occasion of delay of Execution afd of the damages (203) aforesaid &.c
And whereupon the Same Thomas by Levin Gale his attorney Complaines that whereas he the said Thomas the tenth day of December anno Dom One thousand seven hundred and twenty Six at Somerset County within the Jurisdiction of this Court demised unto the afd Catherine a Certain Messuage and One hundred Acres of Land with the appurtenances in the County afd to have and to Occupy by the said Catherine her Executors and adm.rs from the afd tenth day of december for the Space and term of One Year next following fully to be Compleat and Ended Rendering rent therefore unto the said Thomas the quantity of five hundred pounds of tobacco and the said Catherine afterwards viz.t the same day and year afd at the County afd and within the afd Jurisdiction in Consideration of the said demise so as aforesaid made upon herselfe assumed and to the said Thomas then and there faithfully did promise that she when she should be thereunto requested after the Expiration of the term afd of one year the afd Messuage and One hundred Acres of Land with the appurtenances unto the said Thomas would deliver in as good repair as she the same did Receive also the said five hundred pounds of tobacco unto the said Thomas would well and faithfully Content and pay nevertheless the said Catherine her promise and assumption afd in form afd made Little Regarding but plotting and fraudulently Intending him the Said Thomas in that part Craftilly and Subtilly to defraud and deceive the said Messuage and One hundred acres of Land with the appurtenances after the Expiration afd of the term afd unto the said Thomas hath not in as food order and repair as at she received the same delivered nor the Said THomas the quantity of five hundred pounds of tobo or any Part thereof paid or him for it Contented altho the sid Catherine the same to do after the making the promise and assumption afd ^at^ the Expiration of the term afd viz.t the tenth day of January anno Dom One thousand seven hundred and twenty Eight at Somersett County afd within the afd Jurisdiction by the same Thomas was Requested but the Same hitherto do hath altogether Refused and Still doth refuse whereby the Same Thomas says he is worse and hath damage to the value of five thousand pounds of tobacco and thereof he brings this Suite &.c Levin Gale P Quer Pledges &c Jno Do ri Roe And the aforesaid Catherine Dyall by Francis Allen her attorney Comes and defends the force & Injury when &.c and prays Leave to Imparle hereunto untill the next Court and she hath it and the Same day is given to the afd Plft here also &c Att which said next Court to witt the Eighteenth day of March anno Dom One thousand Seven hundred and twenty Eight Comes again as well the afd Thomas Walker as the afd Catherine Dyall by their attorneys afd and the afd Catherine Dyall by her said attorney prays further Leave to Imparle hereunto untill the Next |
