202 by the same Joseph in form afd Confessed as also three hundred and five pounds of tobacco for those ^his^ Costs and Charges afd to the same Henry at his request by the Court here of the Consent of the partyes afd adjudged and afterwards here in Court the afd Henry Fitzwaters by his attorney afd freely releaseth unto the afd Joseph the Costs afd being two hundred and five pounds of tobacco therefore the said Joseph MccClester of the afd three hundred and five pounds of tobo be quiet and ye afd deft in Mercy &.c
he might have his body before his Lordships Justices of the County Court of Somersett to be held at dividing Creek the third tuesday of March then next to answer unto James Dickerson of a plea of trespass upon the Case &.c and that thereof he should not fail &.c Att which said third tuesday of March to witt the Eighteenth day of the Same month ann.o Dom One thousand seven hundred and twenty Eight being the day of the return of the said Writt Cometh the said James Dickerson by Levin Gale his attorney and the sher of Somersett County to whom the foregoing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed vizt Cepi Corpus p John Purnall sher Whereupon the said Sher altho' solemnly Called brings not in the body of the said Robert Gibbs according to the Return of the writt in the plea afd thereupon further day is given unto the afd Robert Gibbs untill the next Court and the same day is Given unto the afd plft here also Att which said next Court to witt the seventeenth day of June anno Dom one One thousand seven hundred and twenty Nine Comes againe the afd James Dickerson by his attorney afd and thereupon a Certain John Dennis Jun.r of Somersett County present herein Court undertakes for the said Robert Gibbs that if in Case the said James Dickerson shall recover Judgmt in the plea afd untill the afd Robert Gibbs or that the said Robert Gibbs shall be therein Convict that then he the said Robert Gibbs shall pay the Condemnation of the Court thereupon or render his body to the Custody of the Sherr of Somersett County in Satisfaction thereof or that he the said John Dennis Jun.r will do it for him, And whereupon the said James Dickerson by Levin Gale his attorney Complained against the afd Robert Gibbs in the plea afd as following vizt Robert Gibbs Late of Somersett County Mariner was attached to answer unto James Dickerson of a plea of trespass upon the Case &.c And whereupon the said James by Levin Gale his attorney Complained that whereas the said Robert the tenth day of May ann.o Dom one thousand seven hundred and twenty seven at Somersett County afd within the Jurisdiction of this Court was Indebted unto the said James in the sum of three pounds three shillings and one penny sterling and being so thereof Indebted unto the said Robert in Consideration thereof |
