178 Year did acknowledge himselfe to be bound unto the said George in One thousand three hundred and twenty Six pounds of good sound Merchantable Leafe tobacco in Caske to be paid unto the said George when he should be thereunto required yett the said William tho' often thereunto Required the said One thousand three hundred and twenty six pounds of tobacco to the said George he hath not Rendered but the same to him hitherto to render hath denyed and Still doth deny and Unjustly detaine to the damage of the said Heather George of two thousand pounds of tobacco and thereof he brings this Suite &c F Allen P Quer Pledgs &c Jno Doe R Roe And Whereupon the afd William Merchment in his Own proper person Cometh and defendeth the force and Injury when &.c and says that he cannot deny the action afd of the aforesaid George Tull nor but that he Owes the same George the aforesaid One thousand three hundred and twenty Six pounds of tobacco in manner and form as the afd George above against him hath declared &c Therefore it is Considered that the aforesaid George Tull recover against the aforesaid W.m Merchment One thousand three hundred and twenty six pounds of good sound Merchantable Leafe tobo in Cask his debt afd and his damages by Occasion of the Detaining of the Same debt to two hundred & four pounds of tobacco to the Same George of his assent by the Court here adjudged & ye afd deft in mercy &c
sound merchantable pork which to him he Owes and Unjustly detaines &a And whereupon the said Hutton by francis Allen his attorney saith that whereas the aforesaid John the Eighth day of August One thousand seven hundred and twenty Eight at Somersett County aforesaid within the Jurisdiction of this Court by his Certain writing Obligatory which the said Hutton with the Seal of of the said John the seal of the afd John Signed hereinto Court brings the date whereof is the Same day and year did acknowledge himselfe to be bound unto the said Hutton in the afd One thousand pounds of good sound merchantable porke to be paid to the Said Hutton when he should be thereunto required yett the the said John tho' often required the said One thousand pounds of pork to the said Hutton hath not rendered but the same to him hitherto to render hath denyed and Still doth deny and unjustly detain to the damage of the said Hutton of five pounds Curr.t mony and thereof he brings suit &c f Allen P Que Pledgs &.c Jno Do R Roe And the said John Bishop in his Own proper person Cometh and defendeth the force and Injury when &.c and sayth that he Cannot gainsay the the action afd of the afd Hutton nor but that the writing Obligatory afd is his act and deed nor but that he Owes the aforesaid Hutton the afd One thousand pounds of Pork in manner and form as the aforesaid Hutton above against him hath declared &c Therefore it is Considered that the afd Hutton Hill recover against the afd John Bishop One thousand pounds of good Merchantable pork his debt aforesaid and his damages by occasion of the detaining of the Same debt to two hundred and Six tenn pounds of tobacco to the Same Hutton by the Court here of his assent adjudged and the aforesaid deft in Mercy &c |
