178 and says that he Cannot gainsay but that he hath of the rights and Creditts of the said Andrew Wailes to the value of five pounds Curr.t mony of Maryland nor but that the Same Ought to be condemned in his hands for the value of the said Joseph MccClester as of the Rights and Creditts of the said Andrew Wailes which the said Plft doth not gainsay Whereupon the aforesaid Joseph MccClester prays that the afd Sums so as afd Confessed by the said Levin Gale as of the rights and Creditts of the said Andrew Wailes may be Condemned in the hands of the afd Joseph Venables and Levin Gale to wards satisfying unto the afd Joseph MccClester his damages and Costs of Suit Recovered agt him according to act of assembly in Such Case made and provided and all Costs accrewing upon the writt of attachment afd Therefore it is Considered by the Court here that the afd sum of Twelve pounds six shillings and Eleven pence Ster mony part of the sum so attached and Confessed be Condemned in the hands of the Said Joseph Venables as of the Rights and creditts of the said And.w Wailes to wards satisfying unto the said Joseph MccClester his damages and Costs of a Certain Judgm.t recovered against him as also all the Costs accrewing upon the writt of attachmt afd and that the afd Joseph MccClester have there of his Execution ag.t the afd Joseph Venables according to act of assembly &a Therefore it is Considered by the Court here that the afd Sum of five pd.s Currant mony part of the Sum so attached and Confessed be Condemned in the hands of the said Levin Gale as of the rights and Creditts of the said Andrew Wailes towards Satisfying unto the said Joseph MccClester his damages and Costs of a Certain Judgm.t recovered against him as also all the Costs accrewing upon the writt of attachm.t afd and that the afd Joseph MccClester have thereof his Execution against the said Levin Gale according to act of assembly &a
