form afd Confessed as also Two hundred and Ninty Nine pound of ^tobo^ for his Costs and
Charges afd to the Same John Murray at his request by the Court hereof the
assent of the Parties afd adjudged which Certain Damages in the Whole do amount
to four pounds thirteen Shill.s ^and nine pence^ Curr.t Mony & Two hundred and Ninty Nine
pounds of Tob.o with Stay of Execution till the tenth day of November Next

   The same
 Somersett County fs    John Magan Late of Somersett County Schoolmaster
was attached to answer unto Moses Cheille of a plea of trespass upon the
case &.c
                                                                And whereupon the said Moses by Francis Allen by his
attorney Complains that whereas the said John Magan the twenty seventh day of October anno
Dom seventeen hundred and twenty Eight at somersett County aforesaid within the Jurisdiction of this
Court was Indebted unto the said Moses in the sum of six pounds Eight shillings and Nine pence
Curr.t money as by account here unto annexed and hereinto Court produced may appear and being
so thereof Indebted the said John Magan in consideration thereof the day and year aforesaid at
the County aforesaid upon himselfe did assume and ^to^ the said Moses then and there faithfully did
promise that he the said John the said six pounds Eight Shillings and nine pence to the said Moses
when thereunto afterwards he should be requested he would well and faithfully pay and Content and altho'
the said John Magan one pound ten shillings and Six pence Curr.t money Pcell of the aforesaid
six pounds Eight shillings and nine pence Curr.t money to the aforesaid ^Moses^ he hath paid and Satisfied
yett as to four pounds Eighteen shillings and three pence residue thereof the said John Magan his
promise and assumption aforesaid in form aforsaid made nothing regarding but plotting and fraudulent
intending the said Moses in that part Craftilly and Subtilly to deceive and defraud the said four
pounds Eighteen shillings and three pence to the said Moses altho' the same to do the said John Magan
on the aforesaid twenty seventh day of October in the Year aforesaid and often afterwards at the
County aforesaid by the said Moses he was thereunto Requested hath not paid or to him for the same in any
wise Contented hath not paid but the same to him hitherto to pay or in any sort to Content hath refused
and still doth refuse and deny whereupon he saith he is worse and hath damage to the value of
Nine pounds ten shillings Like money and thereupon he brings Suite &c   f Allen P Quo Pledgs &a Jno Do R Roe
