                                    John Magan late of somersett County Schoolmaster was attached
                                    to answer unto John Atkinson of a plea of trespass upon the Case &c
And whereupon the said John Atkinson by Francis Allen his attorney Complaines that whereas
the said John Magan the twenty sixth day of march ann.o Dom One thousand seven hundred and twenty
Eight at somersett County afd within the Jur of this Court was Indebted unto the Said John Atkinson
in the Sum of three pounds two Shill.s & ten pence Curr.t Mony of maryland as by acc.t hereunto
Annexed and here in Court Produced may appear & being so thereof Indebted the Said Jn.o Magan
in Consideration thereof the day & year afd at ye Co.ty afd upon himselfe did assume & to ye
Said Jn.o Atkinson then & there faithfully did promise that he ye Said John Magan
the Said three pounds two Shills & ten pence Curr.t Mony to ye Said John Atkinson when
thereunto afterwards he Should be requested he would Well & faithfully pay and
Content Nevertheless ye afd John Magan his promise & assumption afd in form afd
made Nothing Regarding but Plotting & fraudulently Intending ye Said Jno Atkinson
in that part Craftilly & Subtilly to deceive & Defraud ye Said three pounds
Said Jn.o Magan on ye afd twenty Sixth day of March in ye year afd & often afterwards
at ye Co.ty afd by ye Said Jn.o Atkinson he was thereunto requested hath not
paid or to him for the Same in anywise Contented hath not paid but the Same
to him hitherto to pay or in any Sort to Content hath refused & Still doth refuse and
Deny Whereupon he Saith he is worse & hath Dam.s to ye Value of Six pounds mony afd
& thereupon he Brings Suite &a         F Allen P Quer pledges &.a  Jno Doe Richd Roe

                   Whereupon the aforesaid John Magan in his own proper person appears and
    thereupon the said John Magan at the prayer of the plfts attorney afd is adjudged to give speciall
bail to the action afd  Thereupon a Certain William Handy of Somersett County Gent present herein
Court in his proper person undertakes for the aforesaid John Magan that if in case the aforesaid John
Atkinson shall recover Judgm.t in the plea afd against the aforesaid John Magan or that the afore
said John Magan shall be therein Convict that then he the Said John Magan shall pay the Condemnation
of the Court thereupon or render his body unto the Custody of the Sherr of Somersett County in Satisfaction
thereof or that he the Said William Handy will do it for him &.a

          And the aforesaid John Magan in his Own proper person Comes and defends the force and Injury
when &.c and says that he Cannot Gainsay the action afd of the aforesaid John Atkinson nor but that he did
assume upon himselfe in manner and form as the aforesaid John Atkinson above against him hath
Complained And as to the damage of the same John Atkinson by him by occasion of the premisses in
