to Examine Evidences on behalfe of a Certain Levin Gale, John MccClester & Jos: MccClester of the County afd Gentl in Relation to the bounders of three Lotts of Land Lying in white haven Town on Wickacomoco River in the County afd viz.t N.o 3 and N.o 6 as p the Records of the said Town &.c we therefore require you or any three or two of you at some time and place as to you or any three or two of you shall seem Convenient you mete on the afd Lotts Numbred as afd [you first haveing taken your Oath on the holy Evangelist of almighty God according to act of assembly in Such Case made and provided] and there Cause to come before you or any three or two of you all such Evidences as shall be to you or any three or two of you Nominated by the said Complainant (or Deft if any) and that you Examine them upon their Corporall oaths to be by you or any three or two of you administred on the holy Evangelist of almighty God in the presents of the Complainant (or deft if any) touching the truth or remembrances of their Knowledge or any thing that may relate to the Cause afd and that reduceing the severall depositions into writting you send the same together with this Our Commission under your or any three or two of your hands to us to Our County Court of Somersett with all Convenient speed wittness Sam.ll Hopkins Gent Chiefe Justice of our said Court &c On the back side of the foregoeing Commission it was thus Endorsed viz.t The within Commission Executed by us the Subscribers this 31st day of July ann.o Dom 1728 as appears by the severall Depositions hereunto annext Robert King White haven Town the 31.st July 1728 Thomas Gillis By vertue of a Commission to us directed beareing date the twenty fifth day of Novem Ann.o Dom One thousand Seven hundred and twenty Seven we being first ^duely^ Quallified according to Act of assembly did proceed to Examine Thomas Walker agd fifty three years or there abouts being sworn on the holy Evangelist of almighty God saith that at the time that white haven Town was Laid Out which appears by the platt of said Town to be in the year of Our Lord one thousand seven hundred & seven he y.e said Deponient was Present & that to the Best of his Knowledge the North Bounder of one of the front Lotts Number Six stood where there now stands a Cedar post by the Edge of a marsh behind Cap.t George Gales house about forty two foot from the Bank of Wickacomoco river and Stands in a line drawn South twenty six degrees East to the brink bruik of the first turn of a Creek Call'd Dashiells Creek alias Walkers and further saith Not |
