128 force and Injury when &.c and prays Leave to Imparle hereunto untill the Next Court and she hath it and the same day is given to the afd Plft here also Att which said next Court to witt the twentieth day of August Anno Dom One thousand Seven hundred and twenty Eight Came againe as well the afd John Rider as the afd Eliz.a Dashiell by their attorneys afd And the said Eliz.a Dashiell by her said attorney saith that she Cannot gainsay the action afd of the afd John nor Can she say but that the Said Christopher in his life did assume upon himselfe in manner and form as the afd John above against her hath Complained and as to the damage of the Same John by him by occasion of the Premisses in that Part Sustained the Same Eliz.a saith and Confesseth that the afd John hath Sustained Damage by Occasion of the Premisses besides his Costs and Charges by him about his suit in that part Expended to two pounds Eight shillings and ten Pence halfe Penny and because the afd Jn.o Doth not this deny but prays Judgm.t for his damages abovesaid together with his Costs and Charges afd to him adjudged &c Therefore it is Considered by Consent of the Parties afd that the afd John Rider Recover against the afd Elizabeth Dashiell Admrx as afd two pounds Eight shillings and ten pence halfe Penny Curr.t mony his damages afd in form afd Confessed as also two hundred and thirty three pounds of tobacco for his Costs and Charges to the Same John at his Request by the Court here of his assent adjudged which Certain Damages in the whole do amount to two pounds Eight shillings and ten pence halfe Penny Curr.t mony and two hundred and thirty three pounds of tobacco to be Levied of the goods and Chattells which were of the afd Christopher Dashiell at the time of his death in the hands of the afd Eliz.a Remaining to be administred if so much in her hands she hath and if so much in her hands she hath not than the Costs afd to be Levied of the Proper goods and Chattells of the afd Elizabeth and the afd deft in Mercy &c
And whereupon the same James by Levin Gale his attorney Complaines that whereas ye afd Jn.o ye tenth day of March Anno Dom one thousand Seven hundred and twenty Seven at Somersett County within the Jurisdiction of this Court was Indebted unto the same James in the sum of three pounds Eighteen Shillings and Eleven pence farthing Curr Mony as by acc.o herewithin Court Produced may appear and so thereof being Indebted ye said John in Consideration thereof afterwards to witt the same day and Year afd at the County afd and within the afd Jurisdiction upon himselfe assumed and to the same James then and there faithfully Promised that he when afterwards he should be thereto Requested he (ye) |
