and faithfully Content and pay Nevertheless the said William his promise and assumption afd
in form afd made not regarding but Potting and fraudulently Intending him the same Joseph
in that part Crattilly and Subtilly to defraud and Deceive the afd three pounds and five pence
or any part thereof to the Same Joseph he hath not paid altho' the same to do the afd William
afterwards viz.t the same day and year afd at the County afd and within the afd Jurisdiction
by the same Joseph was requested but he the same hitherto to Do hath altogether refused
and Still doth Refuse whereby the Same Joseph Says he is worse and hath Damage
to the Value of Six pounds and ten pence Like mony and thereof he Brings this Suite &c

             July the 25.th day Anno Dom 1726

    Then Came M.r Joseph Kennier before me the Subscriber one of his L.d ship the Lord
Proprietarys Justice for Somersett County and made Oath on the holy Evangelist of
Almighty God that the above accounts is Just and true as to the Contents and date
thereof and that he never Received any part or Percell thereof Other than what he hath
Given Creditt for sworn before me                        Jn.o MccClester

    Whereupon the afd William Whittington by francis Allen his attorney Comes &
defends the force and Injury when &.c and Says that he Cannot Gainsay the action afd
nor Can he say but that the afd William did assume upon himselfe in Manner and form as
the af Joseph above against him hath declared nor but that he owes the afd Joseph the afd
three pounds and five pence Curr.t mony and the declaration before in all the words Expressly
Confesseth
                                     Therefore it is Considered that the afd Joseph Kennier Recover against
the afd William Whittington three pounds and five pence Curr.t mony his damages afd above in ye
251   declaration afd Specified as also                                                            pounds of tobacco
for his Costs and Charges by him about his suit in that Part Expended to the same Joseph by ye
Court here of his assent adjudged and the afd Deft in Mercy &c
