9 And the afd Southy saith that he by any thing by the afd Joseph above in his plea alledged Ought not to be Barred from having his action afd because he Saith that at ye day of the Impetration of the Originall Writt of him the said Southy against him the said Joseph to witt on the twentieth day of Juen Ann Dom one thousand Seven hundred & twenty four the afd Joseph had Lands and tenements sufficient by herditary descent of the afd William Sumers his brother in Fee Simple whereof him the Said Southy of his debt afd he Could satisfie to witt at Somersett County within the Jurisdiction of this Court and this he prays may be Enquired of by the Country &c F Allen P Qrte And ye Deft in Like manner Dashiell Thereupon Command is Given to the SHerr of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who neither &c to Recognize &c because as well &c of which Said preceipt the said Sherr to witt Joseph MccClester Gentleman Now hereat to witt this Sixteenth day of march ann Dom One thousand seven hundred & twenty four makes Return that he hath ^here^ Ready twelve &c as by his said ^preceipt^ he was Commanded and Now hereafterwards to witt the same day & year Came as well the afd Southy Whittington as the afd Joseph Sumers Son & heir as afd by their attorneys afd and the Jurors of that Jury Impannelled who being Called Likewise Came to witt Wiliam Handy, Thomas Layfeild, Peter Frazer, Charles Townsend, Samuel Alexander, Underwood Renchor, Richard Chambers, Thomas Holbrook Robert Mitchell, William Bratton, Thomas Collier, and John Caldwell Jun.r who being duely Elected tryed and Sworn to say the truth in the premisses upon their Oath do Say that the Same Joseph Sumers brother and heir to the afd William Sumers (to witt on the twentieth day of June one thousand Seven hundred and twenty four) had Lands and tenements sufficient by hereditary descent in the County of Somersett which was the afd William Sumers's in fee simple whereby he Could Satisfie unto the afd Southy Whittington his debt afd Therefore it is Considered by the Court here the sixteenth day of march anno Dom one thousand seven hundred & twenty four that the afd Southy Whittington Recover against the afd Joseph Sumers brother and heir of the Said William Sumers as well the sume of Eighty pounds Curr.t mony of this province his debt afd as also the sum of sixteen hundred and Eleven pounds of tobacco his damages ^which he^ sustained ^as well^ by Occasion of the detaining that same debt ^as for his Costs and Chartges by him about his suite in that part Expended^ which to the Same Southy of his assent by the the Court here adjudged and the afd Defend.t in Mercy &c
Whereupon the said Elizabeth Hobbs wife of the afd Noble Hobbs in her own proper person appears and thereupon the Said Elizabeth Hobbs at the prayer of the plfts attorney is adjudged to give speciall bail to the action afd thereupon a Certain Joy Hobbs of Somersett County Planter present herein Court undertakes for the Said Elizabeth Hobbs that in Case the Said Philip Covington shall Recover Judgm.t in the Plea afd against the Said Elizabeth Hobbs or that the said Elizabeth Hobbs shall be therein Convict (that) |
