85 Whereupon the Said John Benston in his proper person appears and thereupon the Said John Benston at the prayer of the Plfts attorney afd is adjudged to give Speciall Bail to the action afd. Thereupon a Certain Edward Jones of Somersett County Planter present here in Court in his proper person undertakes for the said John Benston that in Case the Said Lewis Jenkins Shall recover Judgmt in the plea afd against the afd John Benston or that the Said John Benston shall be therein Convict that then he the Said John Benston Shall pay the Condemnation of the Court thereupon or render his body to the Custody of the Sher of Somersett County in Satisfaction thereof or that he the Said Edward Jones will do it for him &c Whereupon the Afd Jno Benston in his Own Proper person Comes & defends the force and Injury when &c and Says that he Can not gainsay the Plft his action afd so as afd against him brought nor Can he Say but that the Said Plft Ought to recover his damages by Occasion of the Premisses afd to Eight pounds One Shilling Sterr and Costs of Suite against him which the Said Plft doth not gainsay &c Therefore it is Considered by the Justices here the ^sixteenth^ fifteenth day of Nov.r anno Dom One thousand Seven hundred and Twenty five afd that the afd Lewis Jenckins Recover against the afd Jno Benston his damages afd in form afd Confessed to also the Sum of Eight pounds One Shill Sterling as also the Sum of two hundred and Eighty seven 287 pounds of tobo by the Court here adjudged unto him for his Costs and Charges by him about his Suite in this behalfe Laid Out and Expended and the afd deft in Mercy &c |
