79 thereupon or Render his Body to the Custody of the Sherr of Somersett County in satisfaction thereof or that he the said William Davis will doe it for him Whereupon the said John Hudson Jun.r in his Own proper person Cometh and defendeth the force & Injury when &.c and saith that he Cannot gainsay the Plft his action afd against him brought nor Can he say but that the Writing Obligatory afd is his act and deed and that the debt therein Mentioned is yett due and unsatisfyed wherefore the said plft prays Judgm.t for his debt afd and his Costs and damages sustained by Occasion of the detaining of the same debt to him to be adjudged &c Therefore it is Considered by the Justices here the sixteenth day of Novem Anno Dom One thousand seven hundred & twenty four thousands two hundred pounds of tobacco his debt afd as also the sum of twelve hundred and twenty three pounds of tobo for his Costs and damages Sustained by Occasion by Occasion of the detaining of the same debt to the same Joseph of his assent by the Court here adjudged and the afd deft in Mercy &c And whereupon the afd Joseph MccClester by his attorney ^afd^ here in Court freely Releaseth the afd John Hudson Jun.r from the sum of twenty four thousand two hundred pounds of tobo the debt afd therefore ^it is Considered that^ the same John Hudson of the same debt be thereof acquitt &c
Ought to recover against him as well the Sum of Eight hundred and fifty One pounds of tobo the Debt due from the afd Macdowell as the Sum of four hundred and Ninty pounds of tobo his Own Debt wherefore the said Mary Martin Prays Judgm.t for the Debts afd and her Costs and Damages Sustained by Occasion of the detaining of the same debts to her to be adjudged &c Therefore it is Considered by the Justices here the Sixteenth day of Novem anno Dom One thousand seven hundred and twenty five that the afd Mary Martin Exrx as afd Recovered against the afd John Breedy as well the Sum of Eight hundred and fifty One pounds of tobacco the debt of the afd Patrick Mackdowell as four hundred and Ninety pounds of tob.o his Own Proper Debt which in the Whole amoun^ts^ to thirteen hundred and forty One pounds of tob.o as also the Sum of four hundred and Eighteen pounds of tob.o for her Costs and damages Sustained by Occasion of the detaining of the detaining of the same debt to the same Mary Martin Exrx as afd of her assent by the Court here adjudged & the afd Deft in Mercy &c
Whereupon the Said George Hutchins being Called appears and thereupon the said George Hutchins at the prayer of the plfts attorney afd is adjudged to give Speciall Bail to the action afd whereupon a Certain |
