November Court
1725 77 Tayler and Mary his in the plea afd as followeth viz.t Somersett fs: Colebourn Tayler ^late^ of Somersett County Planter and Mary his wife were Attached to answer unto Joseph Macclster of a plea of trespass upon the Case &c And whereupon the said Joseph by Levin Gale his attorney Complaines that whereas the Said Mary whilest she was Sole to witt the twentieth day of November anno Dom one thousand seven hundred & twenty four at Somersett County afd within ye Jurisdiction of this Court was Indebted unto ye Said Joseph in Eighteen hundred & Ninety three pounds of tobacco for Levies Sheriffs Fees & Publick Dues to ye Said Joseph before that time then & there due oweing & unpaid as by account thereof hereunto annexed may in Court appear & being so thereof Indebted ye Said Mary Whilst She was Sole afterwards to witt ye day & year afd at ye place afd in Consideration thereof upon himselfe did assume and to ye Said Joseph then and there did faithfully promise that She ye Said Mary ye Said Eighteen hundred & Ninty three pounds of tobacco when she shou'd be afterwards thereunto requested she shou would well & faithfully pay & Content & altho' ye Said Mary Whilst She was Sole four hundred & sixty four pounds of tobacco percell of ye afd Eighteen hundred & Ninty three pounds of tobacco to ye Said Joseph She hath paid & satisfied yett as to one thousand four hundred & twenty Nine pounds of tobacco Residue of the afd Eighteen hundred and Ninety three pounds of tobacco the said Mary whilst She was Sole and the afd Colebourn after the Espousalls between them Celebrated the promise and assumption of the afd Mary in form afd made Little Regarding butt plotting and fraudulently Intending the said Joseph in that part Crafitlly and Subtilly to deceive and defraud the afd one thousand four hundred and twenty Nine pounds of tobacco or any Part thereof to the Said Joseph have not paid nor Either of them have paid or Contented altho the Same to do the said Mary whilst She was Sole and the afd Colebourn and Mary after Espousalls between them Celebrated to witt on the tenth day of August ann Dom One One thousand seven hundred and twenty five at the County af within the Jurisdiction afd they were requested and Either of them was thereunto requested but the Same to do have refused and still doth refuse & deny Whereupon ye Said Joseph saith he is worse & hath have damage to ye value of two thousand Eight hundred & fifty Eight pounds of Tobacco & thereof he bringeth this Suite &c L Gale P Quer Pled
order for plea or Judgmt &c Att which Said Next Court to Witt to witt the Sixteenth day of the Same Month November ann Dom One thousand Seven hundred and twenty five Cometh the said Joseph Macclester by his (attrny) |
