Joseph by Levin Gale his attorney Complaines that whereas the afd Walter the twenty fourth day of June seventeen
hundred and twenty three at Somersett County within the Jurisdiction of this Court by his Certain
Writing Obligatory Granted himselfe to be held and firmly bound unto the afd Joseph in the Sum of two
thousand three hundred Seventy and Eight pounds of tobacco to be paid the same Joseph when afterwards
the same Walter should be thereunto Required Nevertheless the Said Walter altho' often thereto required
the afd Sum of two thousand three hundred and Seventy Eight pounds of tobacco to the Same Joseph
hath not Rendered but the same hitherto to the Same Joseph to render hath altogether denyed and still
doth deny whereby the Same Joseph says he is worse and hath damage to the value of three thousand
pounds of tobacco and thereof he brings this Suite &c and the same Joseph Brings hereinto Court the
Letter writing Obligatory afd &c        L Gale P Quer Pledgs &c     Jno Doe R Roe

          Whereupon the Said Walter Tayler being Called appears and thereupon the Said Walter Tayler
at the prayer of the plfts attorney afd is adjudged to give Speciall Bail to the action afd but for
want thereof the Said Walter Tayler is Committed into the Custody of the Sherr of Somersett County
thereto remaine &c    And afterwards in the Same Court Cometh a Certain John White of Marumsco
in Somersett County Planter in his proper person and undertakes for the Said Walter Taylor
that if in Case the said Joseph MccClester Shall recover Judgm.t in the plea afd against the said Walter
Tayler or that the Said Walter Tayler Shall be therein Convict that then he the Said Walter Tayler
Shall pay the Condemnation of the Court thereupon or render his Body to the Custody of the Sherr
of Somersett County in Satisfaction thereof or that he the Said Jn.o White will do it for him &c

          Whereupon the said Walter Tayler in his proper person Cometh and defendeth the force
and Injury when &c and sayth that he Cannot gainsay the plft his action afd against him brought
nor Can he say but that the writing Obligatory afd is his act and deed and that the debt therein Mentioned
is yett due and unsatisfyed wherefore the Said plft Prayeth Judgm.t for his debt afd and his Costs
and damages sustained by Occasion of the detaining the Same debt to him to be adjudged &c

                         Therefore it is Considered by the Justices here the Sixteenth day of Novem
Ann.o Dom One thousand Seven hundred and twenty five that the afd Joseph MccClester Recover
against the afd Walter Tayler as well the Sum of two thousand three hundred and Seventy Eight
375   pounds of tobacco his debt afd as also the Sum of three hundred and Seventy Five     pounds
of tob.o for his Costs and damages Sustained by Occasion of the detaining of the same debt to the Same
Joseph of his assent by the Court here adjudged and the afd deft in mercy &c

             memorand.m the plft by his attorney releaseth the penalty Reserving the principall debt &
Interest untill payment &c

       Safe Keep so that he might have their bodys Before the Justices of Our his Lordship's County
Court of Somersett to be held at Dividing Creek the third tuesday of Novem ^then^ Next to answer unto
Joseph Macclester of a plea of trespass upon the Case &c and that thereof he should not fail &c  
And the afd Joseph Macclester by Levin Gale his attorney proceeded against the afd Colebourn
