memorand.m the plft by his attorney sued Out his Lordships Writt of attachm.t the

Tenor whereof followeth in these words following viz.t
Somersett County fs:  Charles absolute Lord and Proprietary of the provinces of
                maryland and avalon Lord Baron of Baltemore &c  To the Coroner of Somersett County Greeting
       We Command you that you attach any the goods Chattells Rights or Creditts of Jonathan Raymond late
       of Stepney parish in the County of Somersett Planter if they shall be found in your Bailywick to the value
       of three thousand six hundred pounds of tobacco and when you have the same attached or any part
       thereof the same in your Custody Safe Keep so that you have the same before the Justices of our County
       Court to be held at Dividing Creek in Somersett County afd the third tuesday of august Next then and there
       to be Condemned according to act of assembly to and for the use of a Certain Joseph MccClester Sherr of
       the said County unless the Said Jonathan Raymond by himselfe or attorney shall appear and answer unto
       the Said Joseph MccClester in a plea of trespass upon the Case &c according to Law and that by good
       and Lawfull men of your Bailywick you make Known unto the person or persons in whose hands
       you make the same attachment that he she or they be and appear before the Justices of our Said County
       Court to be held as afd to Shew Cause if any he she or they have why the Same goods Chattells Rights
       or Creditts so attached in his her or their hands ought not to be Condemned and Execution thereof had and made
       according to the form of the act of assembly in such Cases made and provided if to him her or them it shall
       seem mete and how you Shall Execute this Writt that you make Known ^to^ our said Justices at the Same
       day and place afd and have you then and there this Writt Wittness Samuel Hopkins Gent Cheife Justice
       of Our Said Court the Eighteenth day of June in the tenth year of Our Dominion &c ann Dom one
       thousand seven hundred & twenty five

                      Att which said third tuesday of August to witt the Seventeenth day of the Same month ann.o
       Dom One thousand seven hundred and twenty five Costs being the day of the Return of the said Writt
       Cometh the said Joseph MccClester by his attorney and the Coroner of Somersett County to whom the foregoing
       Writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words
       following viz.t   To the worshipfull Justices within Mentioned I humbly Certifie that I have attached
       in the hands of Thomas Gillis as the Rights and Creditts of the within Named Jonathan Raymond there
       thousand six hundred pounds of tobacco and I further Certifie that I have given Notice unto the Said
       Thomas Gillis that he be and appear at the time and place within Contained to Shew Cause &c before
       Thomas Dashiell and John Elzey good and Lawfull men of my Bailywick as by the within Writt I am
       Commanded so answers                                          Henry Ballard Coroner

          Whereupon the said Thomas Gillis altho' Solemnly Called to shew Cause &c Comes not but makes default &c
