(29) Staple or other specialty whatsoever &c Be good and Pleadable or admitted in Evidence againest Any Person or Persons after the Principall Debter and Creditter have been Both dead Twelve Years or the Debt or thing in Action Above Twelve years standing and whereas the said Lady Baltemore Hath Commenced this suite on an Obligation Dated the twenty fourth day of November sixteen hundred and Eighty Eight so that Noe Action haveing Been Commenced within the Term of Twelve Year Being the Time Limmited By the said Act for Actions to Be Brought as afd which he is ready to Verifie Wherefore the said Defts Prays Judgment if the Plft her Action afd againest Them to have Ought Dashiell P Deft And the said Lady Baltemore saith that the Plea afd of the afd Deft.s and the Matter in the same Contained is not sufficient in Law to which Plea the Said Lady Baltemore needs not nor by the of the Land is she Oblidged to the same ot answer and this she is Re^a^dy to Verifie wherefore for want of a sufficient Plea in that Part the said Lady Baltemore Prays Judgment and her debt afd Together with her Damages By Occation of the Detaining of her said Debt to her to be adjudged L Gale P Qurt To which Demurrer ye deft Joynes Dashiell P Deft Whereupon all and singular the Premisses being seen and by the Justices here fully Read & understood it seemeth to the same Justices that the plea afd of the afd Thomas Rensha & underwood Rensha Ex.rs as above in Barr pleaded and the Matter in the Same Contained are not Sufficient in the Law to bar and preclude the afd Margarett Lady Baltemore Exrx as afd from having their ^her^ action afd against them Therefore it is Considered by the Justices here the fifteenth day of June ann Dom One thousand seven hundred and twenty five afd that the afd Margarett Lady Baltemore Exrx as afd Recover against the afd Thomas Rensha and underwood Rensha Exrs of Francis Rensha who was Executor of John Renshaw as well the sum of Nine hundred & sixty pounds of tobacco the debt afd (302) as also the sum of three hundred & two pounds of tobacco for her Costs and damages sustained by occasion of the detaining the same debt to the same Lady Baltemore of her assent by the Court here adjudged to be Levied of the goods and Chattells which were of the afd John Rensha at the time of his death in the hands of the afd Francis rensha (who was Exr) (of the afd John Rensha) remaining to be adminstred (and afterwards the said Francis Rensha died testate & appointed the afd Thomas rensha & Underwood Rensha by his Executors) (by the afd Thomas and Underwood rensha Executors as afd) if so much thereof in their hands they have ^&c^ & if so much in their hands they have not &c then the Costs and damages afd to be Levied of the proper goods and Chattells of the said Thomas and Underwood rensh'a & the afd defts in Mercy &c |
