Maryland fs This is to Certify whome it may Concern that this day to wit the 3.d of may 1727 before me Levin Gale one of the Provinciall Justices of Maryland Personally appeared the Reverend M.r James Roberson and took the Severall Oaths to the Government appointed by Act of assembly and also Subscribed the Oath of Abjuration and Test in witness whereof I have hereunto set my hand and Seal the day and year above Levin Gale (seal)
and twenty Six at Somersett County within the Jurisdiction of this Court Indebted unto the afd Thomas in the Sum of thirty pounds for a negro to him at his Especiall Instance and request by the afd Thomas before that time Sold and Delivered and so thereof being Indebted the Same John in Consideration thereof upon himselfe assumed and to the Same Thomas then and there faithfully promissed that he when afterwards he Should be thereto Requested he the afd sum of thirty pounds Curr.t mony unto the Same Thomas would well and faithfully Content and pay Nevertheless the said John his Promise and assumption afd in form afd made Little Regarding and plotting and fraudulently Intending the said Thomas in that part Craftilly and Subtilly to defraud and Deceive he the afd Sum of thirty pounds or any part thereof unto the same Thomas hath not paid or him for it in any wise Contented altho' the said John the same to do afterwards to wit the same day and Year afd at the County afd and within the afd Jurisdiction was thereto Requested but the same John the same hitherto to do hath altogether Refused and Still doth Refuse to the damage of the said Thomas Sixty pounds Curr.t mony and thereof he brings this Suite &c L Gale P Quer pledges &c Jno Doe Richd Roe And whereupon the afd John Purnall in his own proper person Cometh and defendeth the force and Injury when &c and saith that he Cannot gainsay the action of the afd Thomas nor but that he did assume upon himselfe in manner and form as the afd Thomas above against him hath Complained neither Can he Say but that the said Thomas hath Sustained damages by occasion of the Non performance of his promise and assumption afd to thirty pounds Curr.t mony and the same declaration in all the words before Expressly Confesseth &c Therefore it is Considered by the Court that the afd Thomas Purnall Recover ag.t |
