258 Somersett fs Whereas a Certain John Davis of Somersett County Gent petitioned this Court to turn the road from the head of Johnson Creek to the head of Stephen Horseys Creek &c which was by the same Court granted so far that the said John Davis make and Clear a new road as afd is praid as good and as near as the old road and its further Ordered that Thomas Williams and Thomas Dixon both of Somersett County Gent view the same new road by the afd Jno Davis to be Cleared and to see if the same be as near good and passable as the Old Road and to make their Report to march Court next &c by order of Novem.r Court anno Dom 1726 On the back side of the foregoeing it was thus Endorsed vizt March ye 22: 1726-7 May it pleas your worships Gentlemen we have viewed the Road according to order and find it Cleared and as nigh and as dry as the other and we do blieve that the within mentioned Road is as convenient to the Inhabitants as Wittness our hands Thomas Williams Thomas Dixon
afd Alexander on the twenty seventh day of June Ann.o Dom One thousand seven hundred and twenty four at Somersett parrish afd within the Jurisdiction of was Indebted to the said Thomas in the Sum of Eight hundred and fifty pounds of tob.o as P.r Acc.o hereto annext may in Court appear and Being in Debt as afd for and in Consideration afd at the time and place afd did upon himselfe assume and promisse that the afd Eight hundred and fifty pounds of tob.o he would well and truly pay and Content when thereto Requested Nevertheless the said Alexd his promise and assumption afd in form afd made little Regarding the afd Eight Hundred and fifty pounds of tob.o to the said Thomas Valleme altho' often thereto Requested he hath not paid but the same to pay hath Refused and Still doth Refuse to the Damage of the said Thomas of Seventeen hundred pounds of tob.o and thereof he Brings this Suite &c Dashiell P Quer Pledges &c Jno Doe R Roe
And the said Alexander Hudson by Levin Gale his attorney Comes and Defends the force and Injury when &c and prays Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the afd Plft here also Att |
