him Complaines nor Can he say but that the afd Joseph hath Sustained damages by
Occasion of the Non performance of his promise and assumption afd to one thousand
four hundred and forty Six pounds of tobo and the same declaration in all the words
before Expressly Confeseth

                      Therefore it is Considered that the afd Jos: MccClester Recover agt the afd
John WIlliams as well the Sum of one thousand four hundred and forty six pounds
of tobacco his damages afd by him in his declaration above supposed as also the sum of
313   three hundred and thirteen     pounds of tobacco for his Costs and Charges by him about
his suite ^in that part^ Expended to the same Joseph by the Court hereof his assent adjudged and
the afd deft in mercy &c

      Mary Fall
    Command was given to the sherr of Somersett that he Should take Mary Fall
Late of Somersett County widdow if she should be found in his Bailywick and
her should safe Keep so that he might have her Body before the Justices of
       his Lordships County Court of Somersett to be held at Dividing Creek the third tuesday of
       March then next to answer unto Jos: MccClester of a plea of trespass upon the Case &c and
       that thereof She should not fail &c         And the afd Jos: MccClester by Levin Gale his
       attorney Proceeded against the said Mary Fall in the plea afd as followeth viz.t

       Somersett fs      Mary Fall Late of Somersett County Widdow was attached to answer unto Jos:
       MccClester of a plea of trespass upon the Case &c

                      And Whereupon the said Jos: by Levin Gale his attorney Complaines that whereas
       the said Mary the first day of Novem Anno Dom one thousand seven hundred and twenty Six
       at Somersett County within the Jurisdiction of this Court was Indebted unto the said Jos: in four
       hundred and forty pounds of tob.o as by acc.o hereunto annexed may in Court appear and being
       so thereof Indebted the said Mary in Consideration thereof ye day and year afd at the place
       afd upon herselfe did assume and to the said Jos: then and there did faithfully promise
       that she the said Mary the said four hundred and forty pounds of tobo to the said Jos: when she
       should be thereunto Requested she would would well and faithfully pay and Content Nevertheless
       the said Mary her promise and assumption afd in forme afd made nothing Regarding
       but Plotting and fraudulently Intending the said Jos: in that part Craftilly and Subtilly to
       Deceive and Defraud tho often thereunto Requested the said four hundred and forty pd.s of
