232 Promisse that he the said John ye said Fourteen hundred & forty six pounds of Tob.o to the said Joseph when he should be thereunto requested he would well & faithfully pay & Content Nevertheless the said John his promisse & assumption afd in forme afd made Nothing regarding but plotting & fraudulently Intending the said Joseph in yt part Craftilly & subtilly to Deceive & Defraud the said fourteen hundred & forty pounds of Tob.o to the said Joseph he hath not paid tho' often thereunto requested but the same to him hitherto to pay hath refused and Still doth refuse & deny to the Damage of the said Joseph of two thousand eight hundred & eighty two pounds of Tobo & thereupon he Brings Suite &c L Gale p Quer pledges &c J Doe R Roe
A Copy of the foregoing Decl.n & acc.t were made & Sent to be serveded on the D afd Jno Williams ^with^ on the writt in the plea afd &c Att which said third tuesday of march to witt the Twenty first day of the same month anno Dom One thousand Seven hundred and twenty Six being the day of the Return of the writt afd Came the afd Joseph Macclester by his said attorney and the Sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following vizt Cepi Corpus decl delivered in time P Fran Allen sherr And the said JOhn Williams being present herein Court is att the prayer of the plantiffs attry adjudged to give speciall bayle to the action afd thereupon a Certain Richard Beatherd of Somersett County Planter present here in Court undertakes for the afd John Williams that if in Case the afd Joseph MccClester shall Recover Judgmt in the plea afd against the afd John Williams or that the said John Williams shall be therein Convict that then he the said John Williams shall pay the Condemnation of the Court thereupon or render his body to the ^Custody of the^ Sherr of Somrsett County in Satisfaction thereof or that he the said Richard Beathard will do it for him Whereupon the afd John Williams in his own proper person Comes and defends the force and Injury when &c and Saith that he Can not gainsay the action afd nor but that he did assume upon himselfe in manner and form as the afd Joseph MaClester above against him |
