196 bailywick and him should safe Keep so that he might have his body before the Justices of his Lordships County Court of Somersett to be held at dividing Creek the third tuesday of June then next to answer unto Ephraim Willson of a plea of trespass upon the Case &a and that thereof he should not fail &a Att which said third tuesday of June to witt the twenty first day of the same month anno Dom one thousand seven hundred and twenty six being the day of the return of the said Writt Cometh the Said Ephraim Willson by Levin Gale his attorney and the Sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed in these words following vizt Cepi Corpus P Francis Allen Sherr Whereupon the afd John Videl being Called appears and thereupon the said John Videl at the prayer of the plfts attorney afd is adjudged to give Speciall Bail to the action afd but for want thereof the said John Videl is Committed into the Custody of the Sherr of Somersett County there to remain &c the said Sherr ^being^ Present here in Court took Charge of the said John Videl accordingly thereupon day is given to the afd John Videl in Custody as afd untill next Court and the same day is given unto the afd Plft here also Att which said Next Court to witt the Sixteenth day of august ann.o Dom One thousand Seven hundred and twenty Six Comes againe the said Ephraim Willson by his attorney afd and thereupon the said Ephraim by his said attorney declared against the said John Videll in the plea afd as followeth viz.t Somersett County fs John Videll Late of somersett County Gent was attached to answer unto Ephraim Willson of a plea of trespass upon the Case &a And whereupon the Same Ephraim by Levin Gale his attorney Complaines that Whereas the afd John the Eighteenth day of aprill anno Dom One thousand Seven hundred and twenty Six at Somersett County within the Jurisdiction of this Court was Indebted unto the same Ephraim in the Sum of four pounds Sixteen Shillings and nine pence Currant money as by acco.t here within Court produced may appear and so thereof being Indebted the said John in Consideration thereof afterwards to witt the Same day and Year afd at the County afd within the afd Jurisdiction upon himselfe assumed and to the Same Ephraim then and there faithfully promised that he when afterwards he Should be thereto requested he the afd sum of four pounds sixteen Shillings and Nine pence Curr.t money to the same Ephraim would well and faithfully Content and pay Nevertheless the said John his promise and assumption afd in form afd made Little reguarding but plotting and fraudulently Intending the afd Ephraim in that part to defraud and deceive he the afd John the afd sum |
