tuesday of march then next to answer unto John Pope in a plea of trespass upon the Case &a and that thereof he Should not fail &a And whereupon the same John Pope by Levin Gale his attorney Complains that whereas the afd Thomas the tenth day of June ann.o Dom one thousand seven hundred and twenty six at Somersett County afd within the Jurisdiction of this Court was Indebted to the same John in the Sum of Eleven hundred pence as by Acc.o herewithin Court produced may appear & so thereof being Indebted the same Thomas in Consideration thereof afterwards to witt the same day and Year afd at the County afd & within the Jurisdiction afd upon himselfe assumed & ^to^ the same John Pope then & there faithfully promised that he when afterwards he should be thereto requested he the afd Sum of Eleven hundred pence to the Same John wou'd well & faithfully Content & pay Nevertheless the Same Thomas his promise & assumption afd in form afd made Little regarding & plotting & fraudulently Intending the afd John in that Part Craftilly & Subtilly to defraud & deceive the afd sum of Eleven hundred pence or any part thereof to the said John hath not paid or him for it in any wise Contented although often thereto requested but the same Thomas the same hitherto to do hath altogether refused & still doth refuse to the damage of the same John ten pounds Curr.t money and thereof he brings this Suite &c L: Gale P Quer pledges &.c Jno Doe R.d Roe Att which said third tuesday of November to witt the fifteenth day of the Same month anno Dom One thousand Seven hundred and twenty Six being the day of the Return of the said Writt Cometh the said John Pope by his attorney afd and the Sherr of Somersett County to whom the foregoeing Writt was directed Likewise Cometh and maketh Return thereof Endorsed in these words following vizt Non Est Inventus Short note Left P Francis Allen Sherr Whereupon the afd John Pope by his attorney afd prayed that forasmuch as he hath Complyed with the Law in order to an attachm.t he may have Judgmt against the afd Thomas Brown for his damages afd by way of attachment according to act of assembly &a whereupon for that it seemeth to the Court here that the afd John Pope hath Complyed with the Law as Alledged; Therefore it is Considered by the Justices here the fifteenth day of Novem.r anno Dom One thousand seven hundred & twenty Six that the afd John Pope Recover against the afd Thomas Brown as well the Sum of Eleven hundred pence his damages by Occasion of the premisses afd as all Costs and Charges by the said plft Laid Out and Expended about his Suite by |
