And the afd Mary Esom admrx as afd by George Dashiell her attorney Cometh and defendeth the force and Injury when &c and prays Leave to Imparle hereunto untill the Next Court and she hath it and the Same day is given to the afd Plantiffe also Att which said Next Court to witt the Sixteenth day of August Ann.o Dom One thousand seven hundred and Twenty Six Came againe as well the afd Joseph MaClester as the afd Mary Esom by their attorneys afd and whereupon the Said Mary by her said attorney says that She Cannot gainsay but that the afd Benjamin Esom in his life time did promise and upon himselfe assume in manner and form as the afd Joseph by declaring afd above Supposed nor Can She Say but that the afd Joseph Ought to recover his damages by Occasion of the Nonperformance of the promisse and assumption afd to four thousand Eight hundred and thirty Eight pounds of tob.o and Cost of Suite which the Said Plft doth not gainsay &c Therefore it is Considered by the Justices here the Same day and year Last mentioned that the afd Joseph MaClester recover against the afd Mary Esom Admrx of the afd Benjamin Esom as well the Sum four thousand Eight hundred and thirty Eight pounds of tobo his damages afd in form (386) afd Confessed as also the Sum of Three hundred Eighty Six pounds of tob.o for his Costs and Charges by him about his Suite in that part Expended to the Same Jos: by the Court hereof his assent adjudged to be Levied of the goods and Chattells which were ^of^ the afd Benj.a Esome at the time of his death in the Hands of the afd Mary admrx as afd remaining to be administred if so (much) |
