afd to two Pistoles of the value of two pounds Seven Shillings and ten pence Curr.t money and
Cost of Suite against him which the Said Plft doth not gainsay

                Therefore it is Considered by the Justices here the Same day and year afd Last mentioned
that the afd Joshua George Recover against the afd Nehemiah Nicholson as well the sum of two pistoles
of the value of two pounds seven Shillings and ten pence Curr.t money his damages afd in form
218    afd Confessed as also the Sum of fo Two hundred & Eighteen               pounds of tobo for
his Costs and Charges by him about his Suite in this Behalfe Laid out and Expended to the Same Plft by
the Court hereof his assent adjudged with Stay of Ex.n till the ^twentieth^ tenth day of august Next and the afd Deft
in mercy &c

the Last will will and Testament of John Bannister decd was attached
to answer unto Alexander Wordie of a plea of trespass upon y.e Case &c
And Whereupon y.e same Alexander by Levin Gale his attorney
             Complains that whereas the afd John Banister in his Life time the tenth day of Septem
       Ann.o Dom one thousand Seven hundred and twenty four at Somersett County within the Jur
       of this Court was Indebted to the Same Alexander in the Sum of Eight pounds Curr.t money as
       By acc.t here within Court produced may appear and so thereof Being Indebted the Same John
       Banister in his Life time afterwards to witt the Same day & year afd at the County afd within y.e
       afd Jurisdiction upon in Consideration thereof upon himselfe assumed and to the Same Alexander
       then and there faithfully promised that he when afterwards he Should be thereto requested he the
       afd Sum of Eight Pounds Curr.t Money to the Same Allex.d he wou'd well and faithfully Contract
       and pay nevertheless the afd John in his Life time and the ^said^ Merrick since his Death y.e promise
       and assumption afd of the afd John in his Life time so as afd made Little regarding & plotting
       & fraudulently Intending the afd Alexander in this part Craftilly and Subtilly to defraud &
       Deceive Neither the afd John in his Life time nor the afd Merrick since his Death the afd
       Sum of Eight pounds Curr.t mony or any part thereof to the same Alex.d hath paid altho'
       the Same John in his Life time afterwards to witt the Same day & year afd & y.e afd Merrick
       since his Death at the County afd within the afd Jurisdiction was thereto requested but the
       Same hitherto to doe hath refused to the Damage of the Same Alex.d Sixteen
       pounds and thereof he Brings this Suite &c                                                  John Doe
