seems to the Court here that the said James MccMorie hath Comply with the Law as alledged

          Therefore it is Considered by the Justices here the twenty first day of June anno Dom one thousand
Seven hundred and twenty six afd that the afd James Mackmorie adm.r as afd Recover against the afd
308   James Dalyell as well the Sum of Sixty pounds Sterr his damages by Occasion of the premises afd as
all Costs and Charges by the Said Plft Laid out and Expended about his Suite by way of attachm.t against
the goods Chattells Rights or Creditts of the said James Dalyell according to act of assembly in Such Case
made and Provided &c

                        Nehemiah Nicholson Late of Somersett County planter was
attached to answer unto Joshua George of a plea of trespass upon the Case &c
     And Whereupon the Same Joshua by Levin Gale his attorney Complains
       that whereas the afd Nehemiah the tenth day of June Anno Dom one thousand Seven hundred and
twenty five at Somersett County within the Jurisdiction of this Court was Indebted to the afd Joshua in Sum
of two pistoles of the value of two pounds seven shillings & ten pence Curr.t mony for Divers services by
the Same Joshua for the Same Nehemiah at his Especiall Instance and request before y.t time Done &
so thereof Being Indebted the Said Nehemiah in Consideration thereof afterwards to witt the Same day
and year afd at the County afd & within the afd Jurisdiction upon himselfe assumed & to y.e same Joshua
then and there faithfully did promise that he when afterwards he should be thereto requested he the afd
Sum of two pistoles to the Said Joshua wou'd well and faithfully Content & pay nevertheless the s.d
Nehemiah the afd Sum of two pistoles or any part thereof to the same Joshua (altho' afterwards to
witt the Same day & year afd at the County afd & within the afd Jurisdiction Was thereto requested)
hath not paid or the same Joshua for it in anywise Contented but the Same Nehemiah the same
hither to to doe hath altogether refused and Still doth refuse to the Damage of the Same Joshua
of five pounds Currt money and thereof he brings this Suite &c
                                                                  L Gale P Querr pledges &.c  John Doe & Rich.d Roe

    And the Said Nehemiah Nicholson by George Dashiell his attorney Cometh and defendeth the
force and Injury when &c and prayeth Leave to Imparle hereunto untill the Next Court and he
hath it and the Same day is given to the afd Plft also

    Att which Said Next Court to witt the twenty first day of June anno Dom One thousand Seven hundred
and twenty six Came againe as well the afd Joshua George by his attorney afd as the Said
Nehemiah Nicholson by his attorney afd and thereupon the Said Nehemiah by his Said attorneys Says
that he Cannot gainsay the Plft his action afd so as afd against him brought nor Can he Say but that
the afd Plft Ought to Recover his damages by Occasion of the Nonperformance of the promise
