Since the death of the same Robt (to w.ch ^said^ Mary Exr of the Last will & testam.t of the Same Rob.t was at Somersett
County afd within the afd Jurisdiction in Due form of Law Committed) hath not rendred but the Same hitherto
to doe hath altogether Denyed and Still Doth deny to the retarding the Exrx of the testament afd and to the
Damage of the Same Mary Six thousand pounds of tobacco and twenty pounds Currt Money & thereof She Brings
this Suite &.c and the Same Mary brings hereinto Court as well the Lettrs Testamentary &c by which &.c as the
writing obligatory afd &c                                                                                             John Doe

       And the said Price Collins being Called appears and thereupon the said price Collins at the prayer of
the Plfts attorney afd is adjudged to give Speciall Bail to the action afd thereupon a Certain Abraham Smith
and Christopher Glass both of Somersett County present in Court undertakes for the Said Price Collins that if
In Case the Said Marty Martin Exrx as afd Shall Recover Judgm.t in the plea afd against the afd Price Collins
or that the Said Price Collins Should be therein Convict that then he the Said Price Collins Shall pay the Condemnation
of the Court thereupon or Render his Body to the Custody of the Sherr thereupon of Somrsett County in
Satisfaction thereof or that they the Said Price Collins and Christopher Glass will do it for him &c

      And the Said Price Collins in his Own Proper person Cometh and defendeth the force and Injury
when &.c and Saith that he Cannot gainsay the Plft her action afd against him brought nor Can he Say but
that the writing obligatory afd is his act and deed and that the debt therein Mentioned is yett due and unsatisfyed
wherefore the Said Plft Prays Judgm.t for her debt afd and her Costs and damages Sustained by Occasion of
the detaining of the Same debt &c

                      Therefore it is Considered by the Justices here the twenty first day of June anno Dom One
thousand Seven hundred and twenty Six that the afd Mary Martin Exrx as afd Recover against the afd Price Collins
as well the Sum of three thousand five hundred and Ninety Six pounds of tobo three hundred and thirty two pds
of pork and ten Shillings and Six pence Curr.t money her Debt afd as also the sum of three hundred and
(362)   sixty two pounds of tob.o for her Costs and damages Sustained by Occasion of the detaining of the Same
(362)   debt to the Same Mary Martin Exrx as afd of her assent by the Court here adjudged and the afd deft in Mercy &c

Command was given to the Sherr of Somersett County that he Should take
James Dalyell late of Somersett County Gent if he Should be found in his
Bailywick and him Should Safe Keep so that he might have his body
before the Justices of Our Court his Lordships County Court of Somersett to
                be held at Dividing Creek the third tuesday of      June then Next to answer unto James
Macckmory adm.r of the goods and Chattells &.c of John Mackmory dec.d of a plea of trespass upon the
Case &.c and that thereof he Should not fail &c

       And whereupon the Same James Mackmory by Levin Gale his attorney Complains that whereas
the afd James Dalyell the tenth day of June anno Dom one thousand Seven hundred & twenty one at Somrsett
County within the Jur of this Court was Indebted to the afd John Mackmory in his Life time in the
Sum of Sixty pounds Sterr for Divers goods weres & Marchandizes by the same John in his Life
