           This being an action of Debt for Sixteen thousand Nine hundred and
Ninety Eight pounds of tobo &.c wherein the Sherr of Somersett County to whom
       the writt in the Same action was directed Comes and Makes Return thereof to the Court here Endorsed
       vizt                                                                              Cepi Corpus P Francis Allen sherr

                      Whereupon the Said William Davis in his Own proper person appears and thereupon
       the Said William Davis at the prayer of the Plfts attorney is adjudged to give Speciall
       Bail to the action afd thereupon a Certain Abraham Smith and Christopher Glass both of the
       County afd Planters in their proper persons present in Court undertakes for the Said William
       Davis that in Case the Said Benjamin Wailes Shall Recover Judgm.t in the Plea afd against the
       Said William Davis or that the Said William Davis Shall be therein Convict that then he the said
       William Davis Shall pay the Condemnation of the Court thereupon or Render his body to the Custody
       of the Sherr of Somersett County in Satisfaction thereof or that they the Said Abraham Smith and
       Christopher Glass will do it for him thereupon the Said W.m Davis in his Own proper person
       appears and Imparles till next Court &c

was attached Sumoned to answer unto Francis Allen Sherr of the County afd
of a plea that he Render unto him the full and Just Sum of Eight thousand
       pounds of tob.o which to him he Owes and unjustly detaines &c
       And whereupon the Said Francis Allen by Levin Gale his attorney Saith that whereas the afd Tho.s
       Goddard the Eighth day of Novem ann Dom One thousand Seven hundred and twenty five at Somersett
       County afd within the Jurisdiction of this Court by his Certain Writing Obligatory which the
       said Francis Signed with the Seal of the Said Thomas hereinto Court Brings whos date is the
       Same day and year afd granted himselfe himselfe to hold and firmly Bound to the Said Francis in the
       afd full and Just Sum of Eight thousand pounds of tobo to be paid the Same Francis when afterwards
       thereunto Required yett the afd Thomas tho often thereto Required the afd Sum of Eight
       thousand pounds of tobacco or any part thereof to the Same Francis hath not Rendered but the
       Same to Render the Same Thomas hitherto to do hath altogether hath denyed and Still doth deny to
       the damage of the Same Francis of ten thousand pounds of tobacco and thereof he brings this Suite &c

       Whereupon the afd Thomas Goddard in his proper person appears and thereupon the Said Thomas
       Goddard at the prayer of the Plfts attorney afd is adjudged to give Special Bail to the action afd thereupon
       a Certain John Caldwell and Allexander Adams both  of Somersett County Gent Present in Court
       in their proper persons undertakes for the Said Thomas Goddard that if in Case the Said Francis
