135 Lordship In Case the Said Jno Lingoe and Robinson Lingo do not make their personall appearance before the Justices of his Lordships County Court of Somersett to be held at Dividing Creek ye third tuesday of august Next and answer unto his Said Lordship Concerning all Such Matters and things as Shall be then and there Objected against him on his Said Lordships behalfe and to Stand and abide the Judgm.t of the Court thereupon and not to depart the Same Court without Lycence thereof and in the mean time to be of the good behaviour towards his Said Lordship and more Especially toward the afd Patrick Kersie &c Thomas Fletcher appears according to his Recognizance Entered into to give Security Evidence against a Certain Mary Ach and is discharged &c John Flemon appears according to his Recognizance Entered into for his good behaviour toward a Certain Daniel Townsend and is discharged &c
take John Caldwell of Somersett County Planter if he Should be found in his Bailywick and him Should Safe Keep so that he might have his body before the Justices of his Lordships County Court of Somersett to be held at Dividing Creek the third tuesday of March then Next to answer unto his Said Lordship Concerning a Certain Presentm.t against him found &.c and that thereof he Should not fail &c Att which Said third tuesday of march to witt the fifteenth day of the Same month ann Dom One thousand Seven hundred and twenty five being the day of the Return of the Said Writt Cometh the Sherr of Somersett County to whom the foregoeing writt was directed ad maketh return thereof to the Court here Endorsed in these words vizt Cepi Corpus P Francis Allen Sher Whereupon the afd John Caldwell by George ^Dashiell^ his attorney appears and prays leave to untill next Court to answer the Premisses afd and it is granted him and the Same day is given unto Levin Gale his Lordship's attorney (who for his Said Lordship in this behalfe prosecuteth) also Att which said Next Court to witt the twenty first day of June Ann Dom One thousand Seven hundred and twenty Six Came againe as well the afd Levin Gale his Lordships attorney who for his Said Lordship in this behalfe Prosecutes as the said John Caldwell Jun.r by his attorney afd and the same Levin Gale his Lordships attorney who as well &c says he will not further prosecute the ye Said John Caldwell in ye Premisses afd Wherefore it is Considered by the Justices here that the afd John Caldwell Jun.r of the Premisses afd be Acquitt &c |
