and defraud the afd seven hundred and fifty Eight pounds of tobacco to the said Robert he
hath not paid or to him for the same in anywise Contented altho' the same to do the said
Thomas by the said Robert on the first day of December in the year afd and often afterwards
at the parish and County afd within the Jurisdiction afd he was thereunto requested but the same
to him to pay or in any wise to Content hath refused and still doth refuse and deny whereupon
the said Robert says he is worse and hath damage to the value of fifteen hundred ninty and six
pounds of tobacco and thereupon he brings this suite &c

          Whereupon the afd Thomas Brown in his Own proper person appears here in Court; and
thereupon the said Thomas Brown at the prayer of the plft by his attorney afd; is adjudged to give
Speciall Bail to the action afd thereupon A Certaine William Calvert of Somersett County Planter
present here in Court undertakes for the said Thomas Brown that in Case the said Robert Martin
shall Recover Judgm.t in the plea afd against the said Thomas Brown or that the said Thomas
Brown shall be therein Convict that then he the said Thomas Brown shall pay the Condemnation
of the Court thereupon or render his Body to the Custody of the Sherr of Somersett County in satisfaction
thereof or that he the said William Calvert will do it for him

            And the said Thomas Brown in his own proper person Comes and defends the force
and Injury when &c and says that he Cannot gainsay the plft his action afd so as afd against him brought
nor Can he say but that the said plft ought to recover his damages by occasion of the premisses afd to
seven hundred & fifty Eight pounds of tobacco and Costs of Suite against him which the said plft
 doth not gainsay  &c  

                                        Therefore it is Considered by the Court here the sixteenth day of
march ann Dom One thousand Seven hundred and twenty four that the afd robert Martin recover against
the afd Thomas Brown as well the sume of seven hundred and Ninety Eight pounds of tobacco his damages
by occasion of the premisses afd in form afd Confessed as also the sume of two hundred and
Eighty Nine                                pounds of tobo by the Court here adjudged unto him for his Costs and Charges
by him about his suite in this behalfe Laid Out and Expended &c and the afd Thomas in Mercy &c
